CBD and Other Marijuana Extracts Illegal Under New DEA Code

On December 14, the Drug Enforcement Administration added a new code for marijuana extracts and made it clear that such extracts, including CBD oil, are illegal.

Although this does not represent a change in federal law, many CBD producers have operated under the assumption that cannabis-based products with less than the 0.3 THC percentage that's allowed in hemp would be legal. But that's not the case, according to this DEA announcement.

Here's the DEA's new definition of marijuana extract that was posted in the Federal Register: "an extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis, other than the separated resin (whether crude or purified) obtained from the plant."

This means that any extract of the plant falls under the Schedule I classification, along with the THC portion of the plant that gets users high. It also applies to CBD products derived from hemp. In fact, according to the posting, the classification applies to all "extracts that have been derived from any plant of the genus Cannabis."

I HATE the fucking DEA!!

They are nothing more than thought police.

Well, IF weed eventually becomes legal, which is slowly but surely happening, then then they will probably have to take this back.

I mean for example, in Colorado CBD must be legal right?

So legal weed in more states will equal legal CBD in more states.

It's GOING to happen sooner or later.

I just hope it's a domino effect where once weed becomes illegal people start questioning which other drugs should be made legal, but I don't think that's going to happen.

The DEA NEEDS to be systematically disbanded.

They should no longer exist.

But governments never admit they are wrong about anything.
 
It's really not clear this is their intent.

It's kind of clear though that if that is their intent, it will fail. The DEA has tried to criminalize hemp and hemp derivatives before and lost in federal court. They can't change the law (Farm Bill, 2014 I believe), without an act of Congress.
 
so sad, very pathetic. since now they are outlawing shit that doesn't even get you high. This is all the dea can even do anymore...since basically everyone in the country smokes pot including most of the people that work for the DEA probably
 
The main issue probably was the appearance of unregulated oils on Amazon and the alike. I am not defending their actions simply saying people shouldn't be selling unregulated "snake oils" on online market places like Amazon, from a dispensary I'd say it's fine. It's the same issue I have with e-cigs from unregulated supply chains, you have no idea what your ingesting.

Again not standing up for them just saying it's best to know where that stuff comes from and what's actually in it.
 
This is really dumb policy, it really pisses me off. then again, this is what we've come to expect from this agency. This is the same agency that allowed the opioid epidemic to flourish on their watch (they control the tap that allows legal opiates to flow into the country) only to shut it all down, shame doctors treating pain, try to ban kratom and stick the government with a multi-billion dollar bill to fix their mess and treat the opoid epidemic (and probably now a booming illegal heroin trade). now they want to throw a wrench into legitimate research into CBD and take away medicine from people with seizure disorders among other things (in states with no medical marijuana laws). Well played DEA, you put job security before people every time. They put most thugs to shame these people
