Canada Meth Smoker Sues Dealer after Overdosing

Fantastic! Now anyone who gets alcohol poisoning can sue the local liquor store.

I OD'd on coke last saturday (see TDS), and I blame nothing but my own goddamn stupidity for doing too much too quickly...

Filing a law suit is the easy part, it's the aftermath that's difficult.

Lawsuits are very draining on the spirit and the wallet. The cost of legal fees, the possibility of appeal on judgement or countersuit (you could end up paying the dealer should you lose and he sues you) should all be heavily weighed when considering filing a suit.

With a good layer it may cost several thousand dollars with no guarantee of victory, the lawyer gets payed eitherway whether you win or lose.
 
Regarding the article, I don't know much about Canadian law, but I wonder how this even became a case in terms of evidence. Surely the guy wasn't brought to court on mere hearsay or accusation, without some type of empirical evidence… otherwise it’s her word against his.

To much information missing to make an informed opinion.

However, vomiting and throwing up blood… first time or not… just doesn’t happen by smoking meth. She is either lying or it’s a highly rare anomaly reaction. Now, if you swallow crystal meth for an extended period of time, say each day for a month, it will begin to tear up your intestine and produce blood in your stool. But honestly, I’ve never once heard of or seen an overdose from smoking meth. Overdose is almost always from oral or IV administration.
 
Keep in mind that she's seeking 50 thousand in damages. Even if she wins there is no guarantee that she will receive any where close to that much. Plaintiffs usually shoot high to bolster their position for settlement. I'm guessing if they do settle she won't walk away with anything more than a couple thousand dollars, which may not even cover her costs of filing.
 
ok of course the lawsuit it retarded but making the guy guilty just cause he wouldn't roll over on his dealer? wtf at least let it go to trial
 
This part baffles me:

He's not selling it for the purpose of inflicting physical and mental suffering. He's selling it for the purpose of making money. Mr Davey is not the only one guilty of knowing the drug was highly addictive and harmful. She knew it too! He is being punished for having that knowledge, yet she is not. Why???
 
Canada is going to shit. I mean it's not like she took a product that is without it's dangers it's methamphetamine made in someones fucking basement probably. Of course your taking risks when your using it holy shit this is the stupidist thing ever.

The judge who let this bitch win the lawsuit must be smoking alot of meth himself cause he sure as hell has brain damage.
