Aus - Mother admits killing 5yo son with methadone

On another article it states

"Her 19-year-old daughter, Tamara, read out a victims-impact statement on behalf of herself and brothers Joshua, 17, and Shane, 16, whom she was raising alongside her own baby."

Which is crap, they all Live with their Father, and Tamara isnt allowed to Move out with the baby untill welfare deem her fit in her parenting

Thanks for the update. I'm sure her children do miss her but it doesn't change the fact the little one died. Nobody wins in this situation. If she gets a prison sentence, the kids suffer but they still have their dad. I don't think she will end up doing that much time. If she gets off scot-free, it sends a message that it's ok to administer dangerous medicine not meant for a child. Just sad.

Yeah, I doubt they would allow Tamara and the Baby to Live with her if she did get out...well id hope not anyway

Sentenced this morning, VERY Disappointed in our justice System!

Lisa Ann Collard, 45, put methadone in the bottle because the boy had flu symptoms.

Kristopher Collard-Wilkschat died after drinking the bottle's contents at the family's Modbury Heights home in Adelaide in June last year.

The South Australian Supreme Court was told a pathologist's report showed the boy actually had pneumonia.

Collard pleaded guilty to manslaughter and administering a prescription drug without lawful excuse.

Justice John Sulan said Collard had been on the methadone program since 1991 to treat her heroin addiction.

He said her partner died of an accidental heroin overdose and that had led to Collard being depressed.

"You've suffered from mental health issues, including depression, since the death of Kristopher's father. As a result you cope poorly and this contributed to your actions that led to Kristopher's death," he said.

"I sentence you on the basis that you were grossly negligent and that you knew giving Kristopher methadone was inherently dangerous. This is a tragic case of negligence and conduct which, as I said, was inherently dangerous."
'Enormous remorse'

Justice Sulan acknowledged Collard's motives.

"I'm satisfied that you were trying to help Kristopher," he said.

"I accept that you've suffered enormous remorse from the death of your child and that you are still mourning his loss."

Justice Sulan noted Collard's three other children, aged between 16 and 23, were present in the courtroom and had earlier given a victim impact statement about how they missed their mother and wanted her home.

The woman was sentenced to three years and nine months in prison with an 18 month non-parole term.

Allowing for time already served, Collard will be eligible for parole in less than three weeks from now.

I don't think it's too unreasonable. What she did was insanely stupid, but it wasn't an act of malice and she's very unlikely to do it again, what would locking her up and throwing away the key really achieve?

I know it's not exactly comparable but a lot of parents give their upset children alcohol to calm them down, like rum on the soother, or hot toddy. It's not legal but they do it anyway. A methadone user who is used to feeling better from taking her drugs probably just applied the same logic when trying to give it to her son and he OD'd. Very tragic, and the system is going to be relentlessly unforgiving about it. At least she got manslaughter and not 2nd degree murder.

If this were any other prescription medication she'd be charged with negligence or it would even be ruled an accident.
