Arrested with G-B-L, Advice please.. (UK)

A friend of mine had an unfortunate brush with the law last week. He just confided in me and is quite anxious about things, I wonder if anyone who is a little more aware of the law may be able to offer advice.

The guy drives an expensive sports car and was pulled over by the cops, they claim he was driving irratically but I think this was just they excuse they used to pull over a young man in an expensive car.

They found about a 3rd of a litre of G-BL in one unmarked bottle in the car and another small amount in another bottle in his pocket.

They arrested him kept him in the cell all day then interviewed him. They have a couple who were in a car that was behind him who say he was driving dangerously. I think they are just a couple of fuddy duddys who saw him overtake or something and reckon it was a bit risky. I know the guy wouldnt intentionally drive dangerously.

The cops didnt know what the gb-l was, my friend told them it was a health supplement. They made a song and dance over it suspecting it was a class A drug and sent it away for analysis.

They released my friend on bail, he has to go back in a month to face the music.

The police breathalised him which came up negative. They drugs tested him that came up negative, they also had a doctor test his coherency, (they had him walk in a strait line whilst counting etc) the doctor said he was fine.

They later released him gave him back his car keys and he drove away.

Will they couple the GB-L with the "erratic driving" and take him to court? Or will they just drop the charges because possession of G-BL is not illegal and they have no proof of dangerous driving apart from this couple of people who claim they saw it?

My friend is in a bad way fretting about it, I fear he may go back into a bad binge because of the anxiety.

I think possession of G-bl in the uk is not illegal.

If anyone can help me put his mind a rest I would appreciate it.
 
If he was in a sportscar just say he was using it as a chrome cleaner and had no idea as to the illicit uses of it. I would have thought that would be fairly obvious.
 
Post in the legal forum, your friend would best keep his mouth SHUT PERIOD.
If he has a nice car he can afford a lawyer, don't tell the cops anything.
Make them go through the trouble of proving its GBL, don't hand that to them.

Your friend could be charged with driving while intoxicated if they can prove its GBL, so his best bet is silence and a lawyer.
 
Again, this one can be answered more accurately by the legal guys. There are some people there that really know what they're talking about. Moving over there...

Unfortunately, if he's gone on record as saying he's using it as a health supplement, he's gonna look dubious if he starts changing his story.

I reckon he'll be fine. With no way of proving he was driving under the influence of a leagl substance, I'm not sure what they really have.
 
Ok Thanks. Could he still be charged with driving while intoxicated although the drink, drugs and coherency tests all came up negative?

They had him walking up and down the station counting to 1000, touching his nose with his right hand then his left while counting etc. and he passed all of these and was stated by the police doctor as being of sound mental/physical condition.

They let him drive away after interviewing him for crying out loud!

Yes, but if you're a policeman and you find a bottle of transparent, unmarked liquid which the suspect admits he/she consumes the first thing which pops into your head is "GHB", which is illegal.

Doubtlessly they will send it away to be chemically analyised and when they do discover it's GBL they might have various questions about "So what do you use it for?" "Why so much?" "Do you know what GHB is?". After all 3l is a hell of a lot to have and unless the guy has a HUGE habit, it's hard to explain it away for personal use. The notion of 'bulk buy for cost' is going to be hard for them to accept.

Driving while on GBL is NOT going to be legal. After all, petrol is legal to own but if you drive while huffing it you're going to be done for driving while intoxicated. He passed all the tests so he should vigorously deny that he was high while driving, since they cannot possibly prove otherwise. They'd be 'fishing' if they implied he was.

If they are real arseholes (and it's been known to happen in the UK!) they'll ask further questions to your friend about his interaction with women, when was the last time he was involved with someone etc, with the clear implication of saying "Do you use it for date rape?".

Tell your friend to stick by his story and even admitting he consumes it for the purposes of enjoyment, they will not really be able to do anything other than taunt him about date rape (which obviously he should deny to the utmost).
 
All signs point to "not guilty" i would still get a lawyer and keep my mouth shut regardless.
 
GHB is, but GBL which is a pro-drug for GHB within the body, is legal. There are grey areas though. If you're caught in your car or walking along with a bottle of GBL only, then you can talk your way out of it, but the police might keep the bottle for testing or might even arrest you on the guess that it's GHB. If you're caught with a bottle of GBL in a public place like a bar, then you're going to have to answer a few tough questions, many of which will be along the lines of "Are you a date rapist?". If you're caught with a bunch of drugs and GBL then they could ask you about it. A number of people in the European section got raided due to research chemicals and among the drugs found were bottles of GBL in many cases. A few got sentences to drug councilling and were asked about their usage of GBL. They were not charged for GHB or anything but their rehab person still knew they were using it as a drug.

Provided you aren't doing something suspicious in a bar, you can get away with having GBL, even 'large' amounts like hundreds of doses.
