Advice on old housemate not paying any bills?

Sorry if this is in the wrong forum, I wasn't sure where to post it as the Legal Advice forum is closed. As I'm from England I thought this would be the most appropriate.

Basically, in 2011- 2012 I lived in a shared house with 3 other people. Unfortunately, the bills were automatically in my name as I moved in first. I cannot add anyone else to the bills now, unless they agree to it. For years the housemate has made excuses and has told me would pay at the end of the month when he gets paid, but then makes another excuse that it will be a few weeks later.. It never happens. (He was a spoilt obnoxious stoner, that would receive large sums of money from his parents but spend it all on weed).

The housemate I lived with for 10 months still refuses to pay any of the outstanding bills (gas, electricity, water, sewage, tv license, broadband, tv). I had to cover him for most of them as the companies wouldn't stop sending bailiff letters. In all, he owes roughly £800. I have offered to give him a reduced price of £520 if he or his father complies and pays in the next 30 days, if not I have told them I will take legal action.

I have his fathers email address, who is the guarantor, and explained everything, but he isn't much help either.

What can I do? Could I take this to court?

I have evidence (emails and messages) of us discussing everything, bank statements of me paying the companies.

I really need to get this sorted as my credit rating is terrible, and I'm sure it's because of this debt.

Please, any advice? Thank you.

Edit: One more thing, he has accused me of harassment for emailing him, asking him to settle the bills.. Also he doesn't want to pay for 6 months of the bills, as he says he was never at the house. (He often stayed at a friends house in the evening, but would be round in the day time to cook and wash his clothes)..

He has just agreed to set up a direct debit next week and send money next week. He has said this about 20 times over the last 3 years. Should I just wait and see if he does? I am concerned that he might just send £20 and never do it again. I think at least a quarter of it should be paid in the next month as it is 3 years over due..

I'd say your best bet would be to visit Citizens Advice to give you an idea of where you stand. I know nothing of legal things but I'm Sure with evidence of them accepting they owe money for the bills you stand a good chance of seeing your money again..

Thanks for replying :). Yes, great idea. I am definitely going to head down there tomorrow. Should I take the messages and bills with me? Maybe I should find the tenancy agreement as well..

Ah, it would be a dream come true to get this sorted out. If I had enough money I would just pay the unpaid gas and electricity bill myself so I wouldn't have to deal with him again.

If I manage to pay off the bills, how long will it take for my credit rating to go down? It's so bad at the moment I can't apply for credit cards, loans, pay monthly contracts or anything.. :(
 
You could maybe take some with you, although I don't think they'll be to interested in looking through to see if you have a case.. They'll just point you in the direction as to where best to take up your issue, it can't hurt taking some though I guess..

I'd back up and photocopy everything you have regarding agreements and acknowledgement from him that they're in the wrOnG. If any of that were to get lost or corrupted on your computer, lose your phone etc, you'd be at a certain disadvantage...

It doesn't sound right that your name was the only one on the bill tbh, just because you was the first one there doesn't mean that any bills, charges, missed payments are your sole responsibility. I'd ask that question at the CAB to.. I'd of thought it should be the landlords responsibility and he charge tenants accordingly as part of the rent.. I may be wrong but it doesn't sound right to me.

As for your credit rating, that can take some time to correct. If you Google improving your CR, it should give you tips on ways to improve it whilst unable to actually get much credit.

This is all just guess work though, CAB and Google should see you right... Got any drug questions?? :D
 
could call a lawyer and ask them... atleast in america most lawyers will talk to you over the phone get a basic run down of the situation and tell ya if anything can be done or if its just a waste of time.... and how much itll cost to retain their services ofcourse... def pays to have family members who have passed the bar...
 
Start proceeding through a small claims court. You have the evidence, so that should suffice.

The guy and his dad will panic once they recieve the notification from the court, and I would have thought the father would pay up immediately to save the hassle.

Call their bluff. Good luck.
 
Well, you could always do as I did when my psychotic speedfreak welsh lodger stopped paying any bills, stole my entire collection of 300 vinyl LPs and locked me out of my own house - that is, ask the local hard bastard nutter to 'have a word with him'. Couple of days later my lodger had disappeared, giving me chance to break into my house, change the locks and board the windows up, and dump all of his possessions on the front lawn. I then sent him a text saying : 'you've got 24 hours to get your shit out of my garden - you have been evicted'. When he still didn't show up, i made a few enquiries. It turned out that the nutter and two of his equally nutty mates had waited outside my house one night for my lodger to come back, jumped him, put a sack over his head then bundled him into the back of a car and proceeded to beat the shit out of him. Then they drove off and dumped him in the road a few miles away, and was then picked up by the police and arrested as he was wanted for a string of offences. He ended up getting sent down so never got his stuff back. What hadn't been robbed by the local smack heads got taken to the tip. Last I heard he was threatening to sue me for 'ruining his life' :- . The down side of this was I never got the money he owed me and he had fuck all worth selling but I was just glad to see the back of him. A bit harsh? Maybe, but he was a nasty piece of work so had it coming....
 
Might be worth having a word with your landlord, some won't want to get involved/give a toss but some could probably offer some kind of resolution. Keeping their deposit for their unpaid share of the bills etc?

It will probably be easiest to give them a phone call. Occasionally you get a crap operator who doesn't know anything, just hang up and get through to another if this is the case.

If there is a contract initiated, they don't have a leg to stand on. You can then go through the small claims court (Easily done online) and report what happened. If they do not dispute it, you can issue a warrant. This will cost £100, but you will get that money refunded through them (Who will have to pay the fees, on top of the rent) when the bailiffs turn up at their address.

If it is not a written contract and they haven't signed anything, but a verbal contract between you, things get trickier. They can then deny the agreement between you and you may have a tough time proving what costs they owe.

EDIT: You say you have email messages, this is sounding good. I don't know if a contract can be legally binded through email messages, this is what you need to find out. You shouldn't have requested the cheaper £520 though... it might be an idea to wait for your 30 days to pass, then get every penny out of them.

yea just a lil harsh... it was a kidnapping and beating you had set up....

shit you should have just kept his shit and sold what ya could... atleast you would have recouped a lil bit of your losses
 
Well in my defence, i wasn't expecting them to go that far, just make some threatening noises at him. What i didnt realise was that my lodger had also seriously pissed off the nutter so he was actually getting his own revenge, not doing it for me. Also, he had absolutely nothing worth selling - in fact he had nothing that i would even touch, he was such a filthy bastard. I had to carry out the clear up wearing welding gloves because he used to just throw his used and uncapped needles into the nearest receptacle. I could go on and on about what a despicable cunt this guy is, but i won't bore you as its not very helpful to the OP.
 
well if his dad's the guarantor then his dad should be shitting himself, unless he thinks he can single handedly fight off an army of baliffs

I just so misread the title of this thread .....

Anyway. I've been there before, fortunately it was just one person out of six so only a fifth as bad as it could have been. Next time, prepayment meters are your friend; keep the prepayment keys / cards in the same place every time and take it in turns to pay each week. And keep a stash of candles in your room just in case.
