There has been a solid inflow of discussion in Aus Social & Events lately about various issues relating to renting, tenancy rights, becoming a home owner and paying a mortgage. In fact, these topics have always been prevalent on BL and given the demographic each of us is bound to fall into one of these categories.

So this is a thread to voice concerns about problems with landlords, neighbours, banks, real estate agents etc etc. If you are facing an issue then there is a good chance that other BL users have been there and may be able to offer assistance.

I live in a unit in Sydney and currently we have a fellow resident who has decided to park one car in their allocated place and their other car in the communal visitors spot. This has been going on for the last 6 months.

A group of tenants and owners have gotten together to address the issue with our strata manager who has only managed to send out a pathetically worded letter. Given several residents have already penned their own strongly worded letter this is hardly a leap forward.

According to the strata manager this is all we can hope to do and the tenant’s real estate agent doesn't seem to think it is a problem. So what next? What would you do? Go semi-postal on the fuckers or just go all Zen and live with it?
 
Also, bring on your stories guys, I am sure that everyone has something to say on the topic. Especialy people renting or buying in Sydney and Melbourne, both cities present some very strong challenges for both categories.
 
Park your car behind him and block him in for a week? or get a mate to park a spare care in his visitor spot for a week? I dont know.. .try contacting a lawyer I guess.
 
Unless you are running out of parking spots for visitors, why do you care that a communal spot is being used by your neighbor? Don't create a problem when one does not exist.

^ He probably is running out of spots for visitors. There is usually only a few spots for visitors in a communal car park and yet everyone in a building has friends. I had the same problem at my last place and it is really annoying.
 
My neighbours dog decided to run its mouth all night last week. It went off to such an extent that by morning it had lost its voice and was squeaking.

I peeked over the fence to see what was going on and then went to knock on the front door but nobody answered.

The dog has not been heard from since so either its dead or they took it away or its completely lost its voice.

Either way I can sleep again.




Regards the car thing. Shits me to tears that they dont provide enough spaces when they build these damn apoartrments etc.

I have a bunch of units next to me and they always overflow outside my house.




My biggest beef though is wqith the tool that warms his car up for ten minutes every morning at 3.00am. One dayt i will snip his radiator lines. There fucker, now it will warm up real quick.
 
For the record we have been allocated one visitor space for 16 units.

Maz - if you told us that after you found out no body was there and the dog was still around then I’d say call the RSPCA. On the occasions when I have done volunteer work for them I have been told by several people that it is very common for people to move and leave dogs and cats behind.

It is as if they think the landlord should shoulder the responsibility of the thoughtful disposal of their pets.
 
Nah they havent moved out cos the car comes home every night. I have no idea why it was going on like it was. Its usually just a pain when someone is arround which I dont mind so much.

The RSPCA has already been called on them once due to them having way to many dogs and other pets in a 3x2 metre back yard. They live like pigs. I hope they own the place because it was brand new only 5 years or so ago and now its an absolute mess.
 
eggman that is one of the most silliest things I have ever read. Why do you even care? He should be able to use his vistors spot allocated to him as he pleases. Talk about an overreaction. Its not hurting anyone, and he has been allocated this spot... he can do as he pleases with it...
 
It's one spot for 16 apartments. Not one spot per apartment. That means no-ones visitors get to park 'cause he is a greedy cunt.

Hang on a second, so your saying it's acceptable for this guy, who lives in the building, to park one of his cars in the spot allocated to his particular unit and then for him to park his 'other' second car in the one and only single visitors spot that is meant to be shared by 16 units and then leave it there?

This is cool for you?

I always thought Immortal Technique was smart enough to understand basic concepts

He probably is, but I clearly am not. I was under the impression there was one VISITOR space allocated per unit as well as the space allocated for yourself. Now that I understand, I understand.

On another note. Are there any real estate agents on here?
Whats with you people inserting clauses's into lease agreements about rental increases at the owners discretion? What would you do if a tennant asked you to remove said clause before signing the agreement. Any advice for tennants or do we just have to cop it sweet?
 
You should be able to get a guarantee of the rent staying at xyz for the period of the lease and after that its up for re negotiation just as your lease is.

Pretty sure that would be law.
 
Apparently the law is that the rent must stay at the same rate for the period of the lease unless the owner inserts a clause into the lease agreement saying other wise. There are limits on the notice period that must be given but so far that is all the info I can find.

I intend to ask them to remove the clause before I sign up, and I doubt that they are going to readvertise and go through the whole application process again all the while leaving the property vacant.
 
Any and all clauses of a contract can be negotiated prior to the execution and settlement of that contract, however, contracts arre bilateral arrangement and the key word here is obviously 'negotiated'.

You will need to identify the clause you wish to amend and then put a strong case forward as to why that amendment should be granted. To be strong in this regard you would be best to have your planned amendment well thought out and a counter argument to any possible rebuttal the other party may have. You may also need to make concessions i.e. we will allow you 'ABC' however you will need to do 'XYZ'.

In the end though all parties must agree on the final wording prior to settlement (i.e. signing), your Property Agent or Landlord may simply just say no thanks and move on to the next applicant. One thing you should keep in mind though is rental demand in your area. If you are inspecting a rental property and 30 others are also at the same inspection then your chances of a rewrite on the lease terms are very low. If however you are inspecting a property that has been on the market for 3-6 months for example then you could negotiate anything. I have heard of people negotiating the first 3 months rent paid in arrears and then monthly rent in arrears after that for 12 months.

When you say RE and Property Agents insert clauses then that has usually been granted by you as the tenant. Read over your lease agreements and you should see clauses like '...blah blah reserves the right to amend these terms at any time during the lease term given X days notice is provided before this amendment becomes effective....'

So in that example the agent has stipulated an amendment and extended a concession to the tenant by way of providing notice. This is typically a blanket clause that covers all facets of the lease agreement.

If you sign something like that (and a lot of people do) then you have invited all benefactors of the leasing of that property to insert amending clauses as they see fit given they observe the concession they have offered you.

Just............aha, I see how they get arround it and I agree there is no way i would allow that in the lease. Actually I struggle to understand how it can be within the law as you are locking yourself into a lease period but not a price. I reckon that could be challenged.

we have a tenant in our place and we stay in a rental with a japanese couple in the second bed and bath, which is cheaper than living in our own place, we have more room, and our flatmates are cool as. i would never live with locals, croats or chinese. each will fuck us one way or another citing "comradery" to either wifey or myself.

the real estate dealing with our rental income was consistantly late with paying us, so we kicked them to the curb with no notice, despite our contract stating that 90 days is required. i cited breach of contract and they're outta here. met up with the tenant, took them out to brunch and made a gentlemanly agreement to give each other 2 months notice of any change in situation. it's a risk, but i made a character assessment when we met them. i feel more secure dealing directly with them.
