2024 US Presidential Election

The Colorado Supreme Court ruled the office of the president falls under the insurrection clause, which states those who previously took oaths to support the Constitution as a “member of Congress,” “officer of the United States,” “member of any State legislature” or an “executive or judicial officer of any State” cannot engage in a rebellion against it.

“The real key issue in this case is — is Trump an officer in the United States in the context in which that term is used in the Article 3 of the 14th Amendment,” Cobb said. “And in 2010, Chief Justice [John] Roberts explained in free enterprise that people don’t vote for officers of the United States.”

Cobb went on to reference multiple Supreme Court decisions that do not conclude officers include the president or vice president in this context.

Steven Cheung, a spokesperson for Trump’s campaign, has already vowed the Trump campaign will appeal the ruling to the U.S. Supreme Court, which has a 6-3 conservative majority and includes three justices nominated by Trump.
 

A 9-0 decision seems unlikely to me. The political environment of the USA definitely affects judicial decisions…they’d like to portray themselves as mostly apolitical jurists pondering the meaning of language in some founding document but c’mon…the decision to award the presidency to Bush during the Bush-Gore election thing, which was 5-4 iirc, broke down neatly along partisan lines, and to say that the decision for Trump will hinge on whether or not Trump is an officer of the USA in the original context of the 14th amendment, that just seems to willfully ignore the political context. The Colorado decision itself wasn’t an absolute blowout one way or the other, it was a close vote

it’s important to stress, in that michigan ruling, that it’s not the end of the road. the decision was specific to trump’s appearance on the primary ballot only.

assuming trump becomes the republican nominee, i assume they’ll just try again.

I guess maybe that district is more amenable to the idea of electing the politician deemed most likely to get finger blasted in the parking lot of a Waffle House, I dunno

Maine elections official disqualifies Trump from presidential primary ballot

"WASHINGTON, Dec 28 (Reuters) - Maine’s top election official on Thursday disqualified Donald Trump from the state ballot in next year’s U.S. presidential primary election, becoming the second state to bar the former president for his role in the Jan. 6, 2021 attack on the Capitol.

Maine Secretary of State Shenna Bellows, a Democrat, concluded that Trump, the frontrunner for the Republican nomination in 2024, incited an insurrection when he spread false claims about voter fraud in the 2020 election and then urged his supporters to march on the Capitol to stop lawmakers from certifying the vote.
