Random MSN Gibberings LIV: teh polis are watching us!

Fucked it. Only just woke up about an hour or so ago. Was meant to be at the physio at 3pm. Fuck knows what happens now, I'm sure on the appointment card it has some raging warning about not giving notice if you cancel an appointment. FUCK SAKE.

From experience mate you will go along and get shown 3/4 exercises and told to do them a few times a day.

Call them ASAP though as its a fucker of a waiting list.

I've been going to the physio every week for a while. I'll phone them the mora & see what the score is.

Also got a letter from my work today. Been off for fucking ages (7 months or so) with "work related stress", was supposed to go back last week but got a line from the Dr for another two weeks, meaning I'd start back on Monday. Thought everything was cooshty but the letter I got the day says that they are now recommending dismissal & I need to go for a meeting with a "decision maker" lol. Bad one. At least it means I can stay up for Superbowl Sunday without fear of sleeping in for work =D

I'll also pump fuck out them at an IT if they do sack me, even though I've been at it I've done everything properly & they haven't. I'm covered by the mental health act & they've done fuck all about finding me alternative work to do, even to the point of lying about there being no alternative work when there obviously is (massive organisation). Compensation ftw!!!

I'm no expert on this but as far as I was aware because my "illness" is completely "work related", if that particular work I'm doing is the thing that is making me "ill" & I am covered by the mental health/disability act then they have to at least attempt to find me alternative work. They have stated clearly that that is not possible, when it is.

They have previously twisted wording of an Occ. Health referral to say that according that doctor I am not fit for any kind of work so finding alternative employment would not be an option, this was during a meeting at which they set a date for me to return to my original job :? So I'm not fit to do a different job, but I am fit to do my original one???

My step-dad used to work for the post office who had a heavy militant union & he regularly dealt with sacking people, he reckons they're fucked if they sack me & I take them to an industrial tribunal.

Primarily Alcohol Tobacco and Ketamine. Have been drinking daily for quite a while now, finding sleep incredibly hard without it but it'll hopefully pass. Want to get back to a stage when I can have excess in moderation and not excess in excess! The daily drinking was also a bitch as it was always after a couple of beers I'd think of cracking open some goodies that really should be saved and not done every day. Not really sure how it started as alcohol really isn't one of my favourite drugs, I spend enough of my time slating it yet drink so regularly...

Mainly making weird electronica at the moment but will be trying my hand at some jungle very soon :)

Same as ...I was never into the booze but it crept up on me when I stopped the full on ravin etc.. the last couple of years it got really bad, last year I was easily doing a couple of litres of whisky a week as standard.
Havent had a drink at all this year but I'm distracting myself with some other bits and pieces;)...the sleep seems to come in the end infact it has to, but thats little cosilation at 3 in the morning :(

I took employment Law, you're not covered. If you are not fit for any kind of work you're not employable. They are well with in their rights to let you go. If you are fit for work but not up to one they have an option for then they can let you go. The only time they're under obligation is if you have a genuine disability with in reasonable terms.

Even with a genuine disability they can let you go if they cannot offer you a position for your needs.

If you're not certified DDA then you've got no recourse.

The thing is, I am fit for work. Until I opened that letter today I was going back to work on Monday.

"If you are fit for work but not up to one they have an option for then they can let you go."

I had been trying for ages to get them to give me an alternative job & would have went back ages ago if they had. I think you know who it is I work for, I don't really want to say out loud lol, they obviously have jobs other than "call centre monkey".

Edit - I thought they were under obligation to do something because both my own & their doctors have said that I'm covered by the Disability Discrimination Act under mental health, or some shit like that.

If they don't have an alternative position for you ( and they only HAVE to find one if you're covered by DDA ) then they are well within their right to let you go.

ha ha, no, PT you never said who you worked for to me personally and I've not guessed. I have no idea. If it's a big company which you said as much then they have a legal team to consult. They know what they can and cannot do.

I'm telling you, if you asked me to represent you ( which I can btw ) You've got no case. I can make sure you keep your job but as for taking them to a tribunal, you'll get laughed out of court. Sorry pal, thats just how it is. I mean it. No one likes being in that position. I wouldn't wish it on anyone.

**Gives atm a massive high 5**
Fuckin ayyy man :)
Nice one!

Thanks (very much), but I don't want to be a fraud on this one, my "distractions" will need to be kept under very tight control, of which I have a very poor track record.
That said after the first couple of weeks the lack of the booze related bowel issues were a real relief:\

It's not exactly a company but they're very big & very clueless. Incredibly clueless in fact. Put it this way, they hired a guy last year to be the head of the call centre I worked in, this guy actually owed them somewhere around £70k which he wasn't paying back because he had been declared bankrupt. He was hired on a higher than average salary for his position & it turned out he was "facebook friends" with one of the people who hired him. When the papers (starting with Private Eye) got a hold of this they ripped them to shreds, so they had to sack the guy & give him a massive pay-out because he hadn't done anything wrong, he had been up front about everything from the start & they had just been so stupid they'd hired him anyway.

TL;DR - They are stupid.

As I've said, as far as I'm aware I am covered by the DDA, their own Dr even said so. They have made no attempt whatsoever to find me an alternative job & the only answer I was ever given regarding that was a very dismissive "there's not many other jobs available, we've had people waiting for years for a different position" then quickly on to the next subject, while I was sitting in a formal meeting with a head full of tramadol (prescription & I had mentioned that at the start of the meeting) so not exactly on top form & a completely fucking useless union cunt sitting next me saying fuck all.

No honey, You need to be certified DDA. You're not covered. My other half is eligible for dda but still hasn't applied for it.

Just because you have work related stress does not qualify you for DDA.

And I know who you work for now. You're not a CS so they'll still be hard on you.

If you've got a good rep you'll keep your job but if you're going alone, I doubt you will.

Yer welcome :)
And I dunno man. I'm someone who also needs atleast some form of crutch to get by in a different situation. So sometimes it's just something that's gunna happen regardless.
True, not ideal, but I guess you've got to weigh up the lesser of the evils :\
