Fines for refusing to take part in ABS health survey

People face fines if they fail to provide information on their health and lifestyle to ABS researchers

UP TO 50,000 people face a fine of $110 a day if they refuse to divulge information on their health and lifestyle to Australian Bureau of Statistics researchers.

The Australian Health Survey announced in last week's Budget will be the most comprehensive research on the health of Australians ever undertaken and will be jointly funded by the National Heart Foundation.

But the 50,000 people chosen to take part will be compelled to do so.

Participants will be weighed and measured and will be asked to give a blood and urine sample.

They will also be asked detailed questions on what they drink and eat and their physical activity.

The ABS said participation "is ultimately compulsory for those chosen by random sampling to ensure the survey accurately represents the Australian population as a whole".

However, participants would only be compelled to answer questions. Providing a blood and urine sample and weighing in would be voluntary.

While it would seek co-operation of those selected, the ABS said it had the power to direct unwilling respondents to provide information.

"If a participant was directed in writing and continued to refuse to comply, they may be prosecuted under the Census and Statistics Act 1905 and a fine may be imposed," a spokesman for the ABS said.

"A fine of up to $110 per day may be imposed until such time as the information is supplied."

Australian Medical Association president Dr Andrew Pesce said the survey would provide valuable information for designing preventative health policies.

"I can't imagine the Government has any intention of prosecuting people who don't co-operate," he said.

National Heart Foundation chief Lyn Roberts said she understood the survey would be conducted in a similar way to the ABS's National Health Survey.

"The difference is a voluntary component allowing participants to provide biomedical data which will allow policy-makers to use verified data on their health for the first time rather than self-reported data, which we know . . . can be unreliable."

I'd tell them to go fuck themselves, as I refuse to have my civil fucking liberties stripped from me to provide them bullshit information. I'm pretty sure what they're doing is illegal.
 
Id argue for as long as possiable but when being threatend with a fine sure il be more then happy to answer their questions. Im 100years old, 700kg, have small pox, had AIDS and drink piss.


If they are going to force people to answer then I bet they get some pretty wild answers
 
I don't know why they don't just wait another 12-18 months until the medicare cards all go online and just extract everyones medical histories and lab reports then. I know that's what the health insurance companies are planning to do. ;)

I recently refused to take part in some other silly survey they were doing so they better not try that shit on me again.

I had a quick read of the Census and Statistics Act. It is pretty vague in regards to what information is required to be supplied. However it does stipulate that failing to provide information or supplying false information is an offence.

"S14 (3) Subsection (1) does not apply in relation to a person’s failure to answer a question, or to supply particulars, relating to the person’s religious beliefs." - Census and Statistics Act (1905)

The above section stipulates that you are not required to answer any questions regarding your religious beliefs. If you were extremely passionate about your civil liberties you could attempt to argue that your lifestyle choices are influenced by your religious beliefs and thus you are not required to answer any such surveys by law. The burden of proof does rest with you in proving this, however i doubt the ABS could really be bothered getting into game of bureaucratic tennis, so may just relieve you from your 'obligation'. Having said that they may engage you to provide evidence of the fact due to the re-selecting of participants affecting the randomized nature of the survey.

I also had a very quick look at legislation relating to trespass and privacy information but couldn't find much of a clash with the clause being relied upon in the Census and Statistics Act (1905). I'll have a more in depth look when i have more time as I am intrigued to the legalities of this and any possible loopholes.
 
Hahaha this article is ridiculious! So who are they going to choose from?They seriously cant make people do things that they dont want to. Id tell them to shove it up their asses and im really hoping that the people who are chosen do the same thing. Who are these douches?

ALso I would like to see the legislation that gives them the power to do this I hope they don't pick me for this shit
