Czech govt defines rules of hallucinogenic plants growing


Prague - The Czech government today approved the list of hallucinogenic plants and mushrooms, including hemp, coca, mescaline cactus and magic mushrooms, and decided that people would be allowed to grow up to five pieces of such plants and keep 40 magic mushrooms at home, a CTK source said.

The cabinet was today also expected to discuss artificial drugs and a permitted amount of these drugs in people's possession.

However, it postponed the debate for two weeks, the source said.

The new Penal Code, which will take effect on January 1, is designed to specify the government's directive. It contains a special provision on the growth of hemp and magic mushrooms.

The government today also approved a directive on the use of anabolics and the list of diseases that will be considered congenial, according to the criminal law.

The law distinguishes between the possession of marijuana and hashish for people's personal needs, for which they will face up to one year in prison, from the possession of other drugs for which they can receive up to two years in prison.

According to the Justice Ministry's proposal that the government did not approve today, the possession of over 15 grammes of dried marijuana or over two grammes of methamphetamine (pervitine), cocaine and heroin will be punishable.

The tolerated amount of drugs in people's possession is at present defined by police internal directives. No one thus knows precisely what amount is considered an amount "larger than a small amount of drug," the possession of which is punishable by the law.

If the government approves the ministry's proposal without changes in two weeks, people will be able to have four pills of ecstasy in their possession and up to five grammes of hashish.

It just always baffles me that if possession of these substances in a certain amount is legal then who would sell those if not the gov't? Its kinda like a catch-22 situation, u can buy, but no one can sell as the amount for possession is not enough for selling.
 
^ That's the point..... The government doesn't want to make a free-for-all. It just wants to stop punishing users.
 
Yes, because drug users can competently synthesize just 2 grams of meth or heroin. And they can totally plant their own coca fields to just make 2 grams of coke. In fact, they can even grow their own marijuana to just have 15 grams of bud. OH SHIT THATS RIGHT, ONE PLANT HAS A SHITLOAD MORE BUD THAN THAT! Whoops, looks like they can't do that.
 
This is good to hear, I got to say I am pretty surprised reading it. I never really thought there was much talk of decrim over there but there you go. The more countries that pull this off the more obvious it will be to the rest of the world that it makes more sense than prohibition.

I thought marijuana possession was already not punishable with jail in Czech Republic. But I guess a character from the romanian movie "politist, adjectiv" might not be the most accurate source.

Anyway, at least the amounts described here for synthetics are much more reasonable than those approved in other countries, where they would set ridiculous limits in the milligram range, seemingly assuming drugs are always pure and that no one ever has a tolerance.
 
^ I agree, I mean these amounts are on the conservative side but alot less so than Mexico for example. 2 grams of cocaine, methamphetamine and heroin, while far from huge amounts are going to get even a very tolerant user off a couple of times unless it was absolute GARBAGE. Compare that to Mexico where you are allowed something like 50mgs of meth or an amount of acid that equates to about half a decent acid tab.

Prague - The Czech government today set the drug possession limits under which the possession of up to 1.5 grammes of heroin, up to one gramme of cocaine and up to two grammes of methamphetamine (pervitine) will not be punishable as of New Year.

Czechs will also be able to legally possess up to 15 grammes of marijuana, according to the Justice Ministry's proposal approved by the government today.
Justice Minister Daniela Kovarova drafted the proposal on the basis of the current court practice.
Kovarova told CTK that last week the authors of the proposal met experts and agreed that the limits used in the current court practice were acceptable.
Initially, the proposal allowed for the legal possession of up to two grammes of hard drugs, she said.
"The government finally decided that it would stick to the current court practice and drafted a table based on these limits," Kovarova said.
Kovarova and Interior Minister Martin Pecina were charged today with assessing the functioning of the new rules after some time.
A week ago, the government approved the list of hallucinogenic plants and mushrooms, including hemp, coca, mescaline cactus and magic mushrooms, and decided that people would be allowed to grow up to five pieces of such plants and keep 40 magic mushrooms at home.
Shortly after the list was released, Czech cacti growers voiced concern about the new government's directive which set limits to growing plants containing mescaline.
Mescaline is a type of hallucinogen which is illegal in most countries.
The growers of cacti intend to hand over a petition to the government that has been signed by 450 people already.
"Many cacti growers have been immediately criminalised with the approval of the limits set by the Justice Ministry as there are some 4000 types of cacti in the world and some of them can contain a certain amount of mescaline," the organisers of the petition which has been placed on the Internet say.
Kovarova today assured cacti growers that they would not be prosecuted.
She said that growing plants that can be used for illegal drug production is a crime under the valid penal law already.
She pointed out that the government's directives would not have a negative impact on cacti growers as cultivating cacti for scientific and botanical purposes does not harm the interests which the Penal Code protects.
She said that cacti growers could ask the Health Ministry for a permission to grow plants for scientific or botanical purposes.
The government's directive will be specified by the new Penal Code that will take effect on January 1.
The code contains a special provision on the growth of hemp and magic mushrooms.
So far, the tolerated amount of drugs in people's possession has been defined by police internal directives and it was unclear what amount of drugs in personal possession is considered an amount "larger than a small one," which is punishable by the law.

Yea it seemed off to me that the limit for heroin was higher than that for cocaine, 1.5 grams of heroin is alot more individual doses than 1 gram of cocaine.
 
So you can grow 5 cannabis plants? That would put you over the 15 gram limit. How about a 1 pound or 1 kilogram limit? It'd be good to stock up in case of a crop failure. But it is good news. Maybe they will work out some more favorable details.
