Yeah they do. This is why for offenses involving multiple felonies, a lot of lawyers actually don't recommend their clients choose drug court as opposed to just serving a few months in jail.
This is my situation right now, actually. I have been charged with 4 felonies, each one caries a maximum sentence of 9 years. So, to get on drug court, you need to be indicted first, and you have to plead guilty to the max of all your charges. So, then if you fuck up on drug court, the judge has the ability to commit you to your full sentence.
Because I have a history of relapsing and fucking up, my lawyer adamantly told me not to do drug court, and just take the 6 month jail term/negotiate for a shorter jail term, because if I mess up on DC, I would be facing multiple years in state prison.
Like I said in my other posts, even though you have to plead to the max for your felonies to get on DC, judges never actually give out the max.. you'll still always get a much harsher sentence than if you would have taken a plea deal, for example.. a common one is 2-5 years in prison. But to actually give somebody the max like that? It's insane.
