What if you get caught by the cops with legal pills on you?

Yesterday, I was thinking a little and wondered what would happen if I were caught with legals. If for example I were to go out and take 2 legal high pills with me. After having consumed the first pill and being high would the cops search me because I were high?( in the UK)

So if the cops would then search me because I were high and what if the would then find the second pill on me? I guess they would assume it's mdma,right? In that case would it be more wise to just outright tell them that it's a legal high or is it just best to shut up and let them do a drug test? Or should I say that it's plant food and that I ingested it accidentally? Legal Highs are legal as long as you don't mean to consume them,no? Or is the not for human consumption just a means for vendor to protect themselves and doesn't apply to users?

Not for human consumption protects vendors.

Legal highs are legal. But a copper will still try and bust you. Depends on the police and the situation. But you cannot be bust for legal highs. You can be dragged off to the station though until they establish whether they want to charge you or not.
 
Say that you've done nothing wrong and had no illegal substances, then say nothing, don't bother mentioning that you took it or anything like that, just state that anything found was legal and keep quiet even when they try make you talk. No crime = no problems
 
It's really simple, don't say anything & ride your hours out till you get bail.
Let 'em test it & go to Court if you have to.

I've found trying to talk to Cops or try to be smart only makes things worse, trust me on that one ;)

clackclick, do you have a reference for that advice re drug test consent? I don't know what the law says about that, would be interesting to see some background. Where are you based? I'm wondering because you've said "Show them your ID" and in the UK there is no requirement to have ID. You can be asked to produce your driving licence but it doesn't need to be produced immediately; i.e. you don't need to carry it with you.

Say nothing to the police, if you want to be polite, you could say "I've been advised not to give comments to the Police". I think that's less rude than the blunt, cliched "No comment" :D

You don't know how they might use what you say. If they ask you where you've been, you might unwittingly and innocently tell them you were at a crime scene and become a suspect. So I would say "I'm sorry but I've had legal advice not to answer police questions". They need evidence to charge you. If they don't have enough evidence to charge you then why give them any information that might be construed as evidence?

I'm not even sure if it makes any sense to tell them that you have a legal substance. I mean, if that worked, then you could do it when caught with an illegal substance ;) So personally I would stick to saying nothing at all.

And don't get caught in the first place.

I am in the UK right now though originally I am from Luxemburg. I know that in every country it is different.
I was once stopped by the cops in Luxemburg when I had an accident with my car because I had taken Temestas and had smoked some pot and also drunk 2 beers. That time I had to go to the Hospital with them and do a urine and blood test.

Another time I was stopped in Germany when I went to the Timewarp in Mannheim. That time I didn't have an accident, but I had taken the LU doves pre ketone ban 2 days before. So when I had to do the sobriety test, my eyes were still vibrating so they thought I had taken Speed. As a result I had to do a quick urine test and before doing it I told them that it would be positive for Cannabis because I had smoked the 2 evenings before. Then when the quick urine test came back positive for weed I had to go with them to the station to also do a blood test. I had to pay 650 Euro to them in cash straight away. However I got the money back, months later, because they couldn't find anything in my blood test. Though I got my driver's license confiscated for 24 hours.

Well, but how about the UK? Could the cops search me if I crossed them on the street just because they suspected I was high? Do I have the right to deny a search?
 
Just tell them I do not consent to any searches, and if they search you anyways... you will win any court case, unless you had a pocked nuclear bomb
 
Wow Josama exactly the same thing happened to my friend in Germany. Well, kind of. Got caught with a small amount of hash driving through Germany, got fined on the spot 600 euros, got a letter six months later, back in the UK, saying here is your 600 euro back. The letter was in German, obviously, and I don't think we ever translated why he got his money back. But he did.
 
They'll confiscate every thing you have just in case it might be illegal - how do they know what's in a white pill. Then when you try to get it back they'll refuse and say "We cannot supply you with substances".
 
I went through 2 and bit months of waiting and trips to the police station miles away from me in Scarborough because I was caught with 3g one of phenazepam one of 2-dpmp and of mxe cost them a fortune to work out what every thing was just to get a slapped wrist then forgot to ask for them back which I think you can do . worst part was I had totally forgot I had them in the house the been in a draw for months grrrr
 
Here is a page with what looks to me like good information on dealing with the police, including attempts to search. General advice seems to be never co-operate, always challenge them and ask them under which power they want to conduct a search. But there are some situations where you have to comply. It's not clear if this information is applicable UK wide, I suspect it is a summary of the situation in England and Wales, as the police powers are slightly different in Scotland (see wiki pages linked below).

Things Police Tell You To Do That You Have To Do

# If you’re actually under arrest, it’s an offence to actively resist or run away (sitting or lying down is passive resistance and is OK). Unless you are passively resisting, it also makes sense to get into a police vehicle if you’re under arrest. You are only under arrest once a police officer has touched you and told you you’re under arrest.

# Under certain circumstances the police have the power to give you directions as to where you must stand and how long you can remain there (for example under sections 12 and 14 of the POA 1986, and section 42 of the CJPA 2001, or if there is an injunction in place)

# There are certain circumstances where not to do what a police officer tells you to do constitutes the offence of obstruction of a police officer in the course of his duty (see under “Trespass” and “Breach of the Peace”).


Unfortunately, you also have to do the following (this list is not exhaustive):

# Stop your vehicle if you’re on a highway and the police signal you to stop (See under “Being stopped in a Vehicle”)

# Give your details in certain situations (see under “Giving Your Details”)

# Let the police search you in certain situations (see under “Stop and Search Powers”)

# Remove a face covering or give the police something they believe may be used as a face covering in certain situations (see under “Criminal Justice and Public Order Act 1994 (CJA)”).

# Let the police take your fingerprints, DNA and photograph if you’re under arrest

# There is one thing worth signing, and some bits of paper that you have to take, when you are under arrest (see under “Getting Arrested”), but don’t sign anything else, under arrest or otherwise.

Under normal circumstances, the police have no right to search you. The situations when they can search you are:

1. If they have reasonable grounds for suspecting that you are carrying stolen or prohibited articles or articles with a sharp point or blade. Prohibited articles are offensive weapons (articles made or adapted for causing injury or carried with the intention of causing injury) and articles made or adapted for use in committing burglary, theft, fraud or criminal damage or carried with the intention of committing these offences. (S1 PACE).

2. Police may search anyone they reasonably suspect to be a terrorist for evidence that he is a terrorist (Section 45 Terrorism Act 2000)

3. If a Section 60 (CJA) authorisation is in effect, police can stop and search anyone in the area covered by the authorisation. This can only be used if there is a risk of serious violence, and you can only be searched for offensive weapons.

4. If a Section 44 (Terrorism Act 2000) authorisation is in effect, police can stop and search anyone for items that could be used in connection with terrorism. They can search pedestrians, drivers and passengers in vehicles. However, S44 has been found to be illegal by the European Court of Human Rights and so should not be used.

The main point to remember here is that unless a section 60 or section 44 authorisation is in effect, the police must have some sort of reasonable suspicion that you are carrying something you shouldn’t be before they can search you. Searches of protestors are normally carried out unlawfully. Therefore challenge the police officer searching you. Ask them under what power they are searching you, and their reasons for searching you. If they are searching you under Section 1 of PACE, ask what they suspect you of carrying, and their grounds for suspicion. If you have been stopped and searched, you do not have to give your details (they will ask), but the police officer must give you a record of the search with his details and the reasons for the search. It’s best not to carry wallets or other personal items that will give the police your identity if you are searched. However, it may be wise to give your details if you want to make a complaint about the search later (see section 5.1). If you know that the search is unlawful and you can prove it, it is best not to co-operate with the search; if they arrest you for obstructing a police officer because of your non-cooperation, the arrest is unlawful and you may be able to sue the police. It is important to video all arrests and the events leading up to them for this purpose (see section 2.7). You can only be searched by an officer of the same gender as you.

Back in 2011 i got 500mg of pre ban meph found on me, cops came, put in a cell for 11 hours, 250 quid fine and a record if i rememeber correctly, why the fuck didnt i refuse? infact i remember trying to get away but they wouldnt let me go
 
You guys get searched often?

Security/etc tend to laugh at me when I offer my pockets/bag/etc up for searching, then shrug and send me on my way.
 
I was searched, by security staff, going into the Bangface weekender at Hemsby. I didn't have drugs on me. I made a lot of noise about it.

They discovered a crystalline substance that looked a bit like MDMA, inside a tube of Berocca I had packed in my rucksack. I was convinced they had planted it on me and made even more noise :D "This is a fucking disgrace!" etc etc. They took the crystals and let me carry on in. I felt humiliated. Only a few days later did I realise that the lid of a Berocca tube contains silica crystals to keep moisture away from the Berocca pills, the lid had cracked and leaked into the tube =D

Yes, almost 18 months since I had loads of shit taken including mobile phone, lab glassware, and a range of controlled and uncontrolled drugs and plant material. I've been to the station twice, once last year and once this year to try to get my stuff, or some of it, back, they just tell me that I'll hear in writing. I am not expecting anything.
