Thank you Stee and do we have access to a copy of this insane Act and it's exemptions floating around anywhere yet? or is that prohibited too?....I've been wondering how on earth alternative medicine and herbalists shop etc are going to manage their orders. Also isn't there a problem in Court with the responsibility of proof of psychoactive substance determination going to be put on the prosecution. As we all know different people react differently to different substances. I know a girl who if she even takes an antihistamine climbs the walls like she's speeding.

The exempted substances schedule is a bit mind bending, as all the things in there are legally not psychoactive, and so they have descriptions like

“alcoholic product” means any product which—
(a)

contains alcohol, and
(b)

does not contain any psychoactive substance.

which is just complete bullshit with any reasonable definition of psychoactive substance.

^all very good points and all herbal remedy etc fall under the act. Chinese medicine is a really big issue.

And in terms of the prosecutor all they have to say is you made and sold it has an effect.

For example RC are solely produced because they "may have an effect" selling them openly and unlicensed for "research" still is intent because they were made knowingly to have an effect, whether it was the purpose of sale intent or not.

That means it goes straight back to the producer / accused to prove it has no effect and they were producing something without any valid reason. A very difficult case to fight.

Can anyone find any reference to personal possession? It covers all the bases on manufacture and supply but nothing on personal possession, except when in custodial.

To me it appears I missed one of the key points of the whole thing. It does actually decriminalise possession! Whatever the pyschoactive substance. But again possession over what is deemed intent to supply seems vague. Maybe it's a bit open like Portugal and comes down to the arresting officer?

Controlled substances under the MoDA are specifically exempted from the regulations of this act, and will still fall under the same restrictions as currently, including for posession. It's a shame, as otherwise it would arguably legalise pot brownies under the food exemptions.

Bugger. And I was about to organise a rave "silent of course" at Westminster for end of April on my own with an E and a gram of Charlie. Damn them damn them all.
