US: Florida ban on smokable medical weed ruled unconstitutional

TALLAHASSEE, Fla. - Florida's ban that prevents medical marijuana patients from smoking their cannabis has gone up in smoke. Leon County Circuit Court Judge Karen Gievers on Friday ruled that a state's ban on smokable cannabis is unconstitutional. Florida's Department of Health said in a statement it has appealed the ruling, which will impose an automatic stay.

How is it unconstitutional though? What was his specific argument?

Either way, very fascinating.
This gist of it is that it infringes on the doctor-patient relationship. To give a little more background, since our idiot politicians in Tallahassee were never going to deal with medical weed, we voters pushed it through in 2016. And the legislature promptly responded by making smoking it illegal. There is a push to get Gov. Skeletor to drop the matter since there was no language in the referendum that passed that limits what form of medical weed can be ingested. This isn't the only medical pot case that is pending in front of the Florida First District Court of Appeals. There's also a case from a Tampa cancer patient.
