i was given a cannabis caution the other day and the cop spelt my name wrong and crossed it out and rewrote it. does this mean the caution is invalid because i heard somewhere if there is anything wrong they have to rewrite it.
Click on your state and see if you can make a call or email to get some free advice on the matter. I'll leave this thread open for now just to see if we get any interesting responses, but in general BL is not the place to ask for legal advice.
Mr Blonde is spot on, I have no legal advice for you BUT my cannabis caution has my surname misspelled so I would also like a response.
I have a feeling that because we signed the piece of paper the spelling of our names wont matter.
There is a limit to how many times you can be cautioned (in Vic anyway) - so there may be some value in following this up. However I don't think you will have much joy...
Most official government documents can have something crossed out as long as they have a signature or initials next to it. Had to do it for a police inquiry about 3 months ago so I'm guessing that would be the common practice.

yup it's the same with any government documents such as centrelink forms or police forms. If he didn't initial next to it you may have a slim chance, but I wouldn't be counting on it.
thanks i spoke to legal aid and it says as long as they corrected themselves after they made the mistake its still valid but if there is a mistake on the offence then it is invalid
