Sniffer Dogs in Victoria

just heard on JJJ news that from next month sniffer dogs will be used in Victorian public places.
they are called PAD's, or Passive Alert Dogs and will have virtually the same legal base as in NSW, ie, reasonable suspicion principle i think.

Yeh, they have been talking about doing this for a long time and Im yet to see it happen, but if it does, I doubt that we will see dogs out and about in the same full force that NSW.
Apparently it is very expensive to use sniffer dogs and that is one reason why its not a more common practice in Melb.

Even so,I would say its not really anything to be concerned about unless you are a person that walks around the city with a reasonable qty of drugs on your person.

You prefer the Liberal's zero tolerance stance? All it means is that you should never have more than a personal amount of illegal substances on you, make sure it is all in the one bag, and be careful about how and where you decide to use.
 
I'm pretty sure the legislation in NSW doesn't allow sniffer dogs to operate in "public places". I know they're allowed to operate in or around public transport and in or around places that serve alcohol (clubs, raves, concerts, festivals) but like I said they aren't given a free reign in public places. I could be wrong though. :\

Not at all. But just because that's worse, doesn't make the labour stance ok.

And can't you still be put through a lot of shit even with a small amount of your drug of choice?

dogs are able to be present in public places as well as other venues such as ones used for entertainment:(
they are just generally used in these places as they are probably the ones which could yield best results

apparently it is a one-month trial in Victoria and available in all public places.

General drug detection with dogs in authorised places
7 General drug detection with dogs in authorised places

(1) A police officer may, without a warrant, use a dog to carry out general drug detection in relation to the following persons:

(a) persons at, or seeking to enter or leave, any part of premises being used for the consumption of liquor that is sold at the premises (other than any part of premises being used primarily as a restaurant or other dining place),

(b) persons at, or seeking to enter or leave, a public place at which a sporting event, concert or other artistic performance, dance party, parade or other entertainment is being held,

(c) persons on, or seeking to enter or leave, a public passenger vehicle that is travelling on a route prescribed by the regulations, or a station, platform or stopping place on any such route.

(2) In this section, "public passenger vehicle" means a train, light rail vehicle or bus that is used to provide a public passenger service.

They can use a dog in a public place but they need a warrant or reasonable suspicion.

8 General drug detection with dogs by warrant

(1) A police officer may use a dog to carry out general drug detection if authorised to do so by a warrant under this section.
(2) A police officer who has reasonable grounds for believing that the persons at any public place may include persons committing drug offences may apply to an authorised justice for a warrant under this section.
(3) An authorised justice to whom such an application is made may, if satisfied that there are reasonable grounds for doing so, issue a warrant authorising any police officer to use a dog to carry out general drug detection in the public place during the period or periods specified in the warrant.
(4) An application for a warrant under this section must disclose whether any general drug detection to be carried out under the warrant will be part of a covert police operation.
(5) Part 3 of the Search Warrants Act 1985 applies (with any necessary or prescribed modification) to a warrant issued under this section.

i stand corrected. i heard that the Victorian legislation was for all public places and a copy of the NSW legislation. well i guess thats a little good news then:\
 
reasonable suspicion is very subjective, and being near a dance music event probably constitutes reasonable suspicion.

Very stereotypical but you are probably right 8) It annoys me how a lot of people associate dance music/dance music events with drug taking, not everyone there is fucked off their faces 8o :)

You don't even need reasonable suspicion to use the dogs for people leaving a dance party. :(
 
it is if the dogs sits next to you, then that constitutes reasonable suspicion of carrying drugs and allows the police to legally search you and your belongings
