Question on mailboxes

A relatively stupid friend of mine has recently engaged in something I warned him was totally dumb.
He is picking up large amounts of pot from a post office box. I told him if it was so safe, why is the guy not doing it him self. Anyway, apparently the other day, he got a business card from a detective in the sherrifs department, and the package was gone. I told him he had little to worry about because if they wanted to fuck him they would of done a controlled delivery. He is freaking way out, and I am trying to calm him down. I recognize he needs to chill out, but really, it seems like it would cost the police a lot of money to tap phones, and follow people around on a hunch. They should of just let him take the package and busted him. What do you guys think the chances are of the police trying to fuck him?

And your legal experience would be great as well.

Receiving pot in the mail isn't really illegal if they can't prove you requested/bought the pot. Your worst enemy could have mailed it to you to frame you. He never signed for it stating that he was aware a package arrived for him, unless they already have done a controlled delivery with a previous package.
 
1. A post office is on federal property. Why the sheriff's would be involved is a mystery to me.

2. As you stated, they would have arrested him there. Because, it is federal property.

3. I believe Cooliois mistaken.

4. Your friend should be ok. But, that depends on his future behavior. I.E., he may want stay away from his " friend".

Unless they have evidence or testimony that demonstrates you knew a package containing illegal goods was coming in the mail for you, they can't do shit.
 
Everybody thinks that. Get a copy of the federal rules and let us know what it says.

PottedMeat, you may be right but it would really help for you to post the info here. I also was thinking what Coolio was thinking - that the government must prove knowledge of the possession. Can you shed some more light on this?

My information is in my memory. I served as an assistant in a federal prosecutor's office for 2 years.

The federal law regarding conspiracy is drastically different that that of most states.
If I had to spend the time giving such detailed explanations and dug up info from fed and state codes, I would not have the time.

Again, a post office Is federal property, hence the fed code applies.

If you are asking me to verify every legal opinion I express, by all means let me know and I will no longer post here.
 
I really do not understand why this matter is being made so complicated.

The second sentence reads; "He is picking up large amounts of pot from a POB."

He knew it was pot and if he made an overt action to attempt to exercise control
over the package he has violated federal law.

I really do not know how to simplify the facts and the law any easier to understand.

It's not a requirement, and your contributions here are appreciated as long as you enjoy making them.

The issue seems to be that in the original post, the poster states as a fact that the citizen is knowingly receiving up pot through the mail. However, from a criminal law standpoint, I think the government must still be able to prove that knowledge if they don't obtain a confession. So both viewpoints are correct depending on one's perspective.
 
Yeah, in no case does his admission of guilt on Bluelight mean he has left any evidence of his guilt for the Sheriffs to find.
 
Why would the sherriff be involved? Does this even happen? Why would they leave a business card? It sounds fishy.

Would a police officer actually leave a business card like this?
 
^ I think they only leave business cards if they need you (aka "JOE S. USPECT") to help make the case for them. Thus, one should never do "business" with them. ;)

Correct me if I'm wrong, but doesn't the FBI/DEA have "agreements" with local law enforcement agencies to do their (relatively) petty work for them?
