FRANKLIN TOWNSHIP — A former Franklin man who was convicted of growing 17 marijuana plants, drugs he said were necessary to treat his multiple sclerosis, today was sentenced to five years in jail.

John Ray Wilson, 37, was convicted in December of second degree drug manufacturing for growing more than 10 plants and third-degree drug possession for psilocybin mushrooms.

Superior Court Judge Robert Reed gave Wilson the lowest possible sentence for a second-degree crime. He noted that while Wilson’s violation of the law is “less egregious” than the others who manufacture controlled dangerous substances, there are others with multiple sclerosis and other chronic illnesses that don’t break the law.

The Somerville courtroom was packed with Wilson’s supporters and those who championed the New Jersey Compassionate Use Medical Marijuana Act, which will take effect in July.

Dressed in a gray suit and white golf shirt, Wilson implored Reed to believe that he is not a bad person. “I don’t want to stand up here and make excuses for what I’ve done,” he said. “I had no malicious intent to start a drug distribution facility. Honestly, it was trying to treat my MS.”

At trial, Wilson was acquitted of the most serious offense, operating a drug-manufacturing facility, a first-degree crime that could have carried a potential 20-year sentence.

Defense lawyer James Wronko insisted that his client never wanted to be the poster boy for the legislation that was the subject of widespread debate. But he did not have medical insurance, and all the other alternative measures he tried to alleviate his symptoms failed.

Wronko asked the judge to give him probation, rather than jail time. In court, he said: “Mr. Wilson’s acts never affected any other members of society, except for the drug companies,” who want people to buy their medications.

Deputy Attorney General Daniel Bornstein argued for a seven-year sentence, insisting the judge consider Wilson’s criminal history. He had four prior arrests since 1992. In the first case, he received admission into the pre-trial intervention program, and was arrested again shortly after his release.

“That did not deter him from engaging in criminal behavior,” Bornstein said. “This shows that he is a compelling risk to re-offend.”

Some choose to treat MS with pharms, others do it with good ol cannabis, which seems to be as effective with fewer side effects, and is given to us human beings by nature.
Who cares if other MS patients don't use cannabis??

So, so true. And yet, this truth couldn't keep the poor guy from jail. :(
 
people ask, "what do you think you will be doing in 5 years?" and you could probably give a good guess, but what will happen in that 5 year time, anything, but nothing good for him, not much for his MS either; never mind the nightmares his family/loved ones will be having.

its also surprising the difference between a full on consumable high yielding/high resin flowering plant, and a little 3-8" clone... or seedling. you dont exactly plant and water marijuana, its a true task that takes a lot of devotion and research, plus luck.

i mean, the mental image one person has, like your average joe/jane watching the news, and assumed results of yield, price, and destination... and reality is usually very different, even for the actual grower 1/2 the time!
 
^ He'll be lucky if he does. More than half of the people I was in jail with who needed legitimate prescription medication didn't get in. And I'm not talking about narcotics or benzo's for anxiety. I'm talking about anti-depressants and anti-biotics and shit. The only thing that was handed out was Thorazine & Mirtazipine, basically 2 sedatives to keep the crazies in line. Only 1 single person I know out of 100's got a narcotic. This guy was from the military and served in Beirut and had his legs & back blow to pieces by frag grenades. He was in on 2nd DUI charge and couldn't make bail. He was prescribed 30mg of oxycodone twice a day. After 3 weeks of severe withdrawl and contacting lawyers, he got the facility to give him 10mg of oxycodone twice a day. Haha, what a joke.

In another case, an inmate friend of mine was on a MM program. He took the jail to court, while in jail (lulz) over it. The jail ended up settling and allowing him to be transported to a MMT center EVERY MORNING to recieve his dose in shackles.

Good luck to this man, I'm sad to be from the state that this attrocity took place in.
 
Were the mushrooms used to treat his MS too? Don't get me wrong I think all this stuff should be legal but in these times having the mushrooms too cast a weird light on the whole I'm only using it for medication. Bah we live in bad times.

Pharmaceutical companies care. If they can bend Obama over(he probably volunteered but beyond the point) and fuck him in the ass in order to turn the healthcare bill into a huge subsidy bill/cashcow for themselves they can fuck you in the ass for both refusing to pay for their drugs AND using another treatment.:X
 
I really don't think this has to do with the marijuana growing. It has to do with the amount of plants he was growing, his previous criminal record and a psilocybin mushrooms. If he was only growing the 17 plants, I doubt he'd get more than 1 year.
 
The government is going after herbal supplements next. They only want you to buy patented factory medicine from big pharma. What the people want doesn't matter anymore. Some 80% disapprove of ObamaCare but the corporate lackeys in Congress passed it anyway. Government works for big business.
