Jan 6 Attack on the Capitol and the aftermath

trump is threatening prosecutors/witnesses/etc. good luck with that.

he's also pleading publicly for the supreme court to "intercede" is his various legal cases.

what does he think they should - or even can - do (at this time)?

he was the president and he seems to have an extremely limited understanding of how the legal system works...

In these latest charges, why do you think trump isn’t afforded first amendment protections? That’s what it will essentially come down to. He’s already convicted in DC, that’s not even up for debate. This will ultimately be decided by John roberts, that’s why trump said what he said imo. The scotus will have to decide where or not he had first amendment protection, as president. Also challenging the electors was a legal remedy up until very recently. It’s why they used a clown prosecutor, it will likely get thrown out. Unless the establishment has something on Roberts, which is very possible.

"this is protected speech" is just a fox news talking point. again, not a great look to just be repeating that. switch off the tv.

maybe the supreme court will get to hear this but the cases haven't even started yet.

it's telling that he seems to have no idea how the justice system works.

and let's not ignore the cynical irony of trump and his apologists whining about freedom of speech when he called, in december last year, for the termination of the constitution.

arguing this is a free speech issue makes you look like an idiot.

Why wouldn’t he be allowed to have the opinion that the election was rigged? More than half of the country thinks this. It’s setting up for a horrifying ruling, that what the establishment deems misinformation is speech you are not allowed to speak, which arguably ends the first amendment.

also "challenging the electors" is a rather naive analysis of what he and his co-conspirators allegedly did. there was a little more to their scheme than that...

The simple fact is that there was a provision to challenge the electors and send them back to the state. There’s is no wiggle room here, it’s just fact. They didn’t use jack smith for no reason at all. This guy has already been unanimously over ruled by the scotus.

Furthermore the two major take aways from the indictment is that they had to doctor what he said to create the narrative, they had to remove where he told his followers to March patriotically and peacefully to the capital.

And that if the judge isn’t subverted his defense will be able to prove the establishment interfered in the election. They have proof that some of the intelligence folx that signed off on the letter that declared the Hunter Biden lap top story to be Russian disinfo knew that the story was real. Yet they still used their influence to censor it. And that definitely effected the outcome of the election.

sure, when you selectively cherry-pick one thing he said and ignore countless other things he said and did, he's a real angel.

as josh marshall so eloquently put it: "...clumsily edited video of an insurrectionist putting back upright a flipped over chair is hilarious because it's so stupid. we should treat it as such."

this kind of disingenuous point-scoring may appeal to people who agree with you online but this is in the hands of the justice system now where evidence and facts carry more weight than assumptions, opinions, insults and reddit-speak.

The simple fact is that there was a provision to challenge the electors and send them back to the state.

indeed. there is a mechanism to do that but the trump campaign failed to avail themselves of it.

from archives.gov:

"Under Federal law, an objection to a state’s electoral votes may be made to the President of the Senate during the Congress’s counting of electoral votes in January. The objection must be made in writing and signed by at least one-fifth of the Senators and one-fifth of the members of the House of Representatives. Only two grounds for objection are acceptable: that the electors of the State were not lawfully certified under a certificate of ascertainment, or that the vote of one or more electors has not been regularly given."

it's too late. they didn't do it.

not to mention that their baseless complaint that "the election was stolen" is not an acceptable objection, per the law.

your understanding of the law on this issue seems about as good as trump's. only the best people.

no comment on trump's proposal to suspend/terminate the constitution? i wonder why...

trump already backtracking on his earlier "i'll come after you" threat. in light of the specific instructions given to him by the magistrate judge at arraignment, he knows he fucked up.

it's interesting to see trump's legal team do everything they can to delay and delay.

if i was accused of a crime of which i knew i was innocent, i couldn't wait to get into court and demonstrate my innocence. trump's s.o.p. is to try to delay as long as possible every time.

show me you're guilty without saying you're guilty...

The censoring of the laptop story was wrong-headed, no doubt. But if you defend one of the greatest shit talker in history by accusing his opponents of obfuscation and dishonesty (of which I am sure there is plenty) it starts to seem selective. You're acting like Trump himself isn't knowingly lying with every breath. Including about nearly every element of the election and the subsequent capitol 'protest'.

What an awful world the elites like Trump have created.

Wow... when I step back and remove myself from the situation, it becomes very clear how the two "sides" (manufactured) of this "debate" (shouting match with earplugs in) are living in totally separate versions of reality.

Only one reality however. In reality trump is horrible news. The guy got sued for racist practices in '63 (that alone not enough to condemn fine). The man tried to overthrow democracy. I really do not see two sides to this coin.

You can probably tell I lean left hard (as I imagine most here do) but I must say I was proud of the GOP for not facilitating his attempted coup. Im back to disliking them strongly promising a pardon on 1. such a solid case 2. such an important case.

Only president to be impeached twice.

Never won the popular vote. (which matters to me idk about everyone else)

Whatever we are calling jan 6th. (a coup)

Facing felonies while running. (any other presidents have this is well?) genuinely curious...

Told the most lies of any president in one term.

I understand being republican, sometimes it even sounds better on paper. But trump is simply bad news. This obviously isn't factual but from what I understand about everyone that knows him hates him. In DC he got like 05% of the vote. Proximity effect lol.

No they don't. Why would you think more than half of the country thinks the election was rigged? Data please.....

And he would be allowed to have that opinion, as an opinion. Actively trying to manufacture votes, begging to find 12k some votes after results are in....that was criminal. Inciting jan 6th was about as criminal as it gets.....

alaisdair has a handle on it and is more informed and articulate on this matter than me surely so I am going to tune out of this thread as I have left my .02 cents

ps. not trusting the mrna does not = white supremist (sp lol). There is probably alot of correlation but no causation. I don't trust the mrna vaccine, but I am damn glad the rest of you do ;) as I do understand some things. I trust ALMOST all other vaccines but some do have risks, lets be real. In 20 years if all is fine I may start trusting them.....

If you REALLY think about it, to still consider yourself on the left you have to be suffering some form of brain damage(possible from the vaccine??? thanks trump!) lefties are literally detached from reality on every fucking level, from the most basic male female issue to the more complex economy that they believe isn’t in a recession all the way to the ukrain war and the money the Biden’s have illegally taken, but prosecute trump amiright ?

^ maybe if you approached things from a more nuanced place than "all lefties are morons" you'd see that there's maybe a little more to it than that? but your approach is certainly the easiest, i get that.

i've never insulted your intelligence and i think you're smart enough to know that two - or more - wrongs don't make a right...

Something funny tho that I’m ashamed I didn’t make the connection myself, I was watching a Andrew tate interview and he was saying lefties are so brainwashed they are like agents in the matrix, like your talking to someone who seems normal and say something like “I dont hate trump” or “trump was clearly a better president” and they go full agent in the matrix and there is a complete 180 and it’s like they are a different person…eeeriiiere
