Normally this might be put under the sex and relationships forum...but im curious about legal action I can take.

My most recent sexual partner recently convinced me to have unprotected sex. I was very hesitant, but I kept being badgered and just eventually said yes. Now, I'm worried about it, and asked him to take an STD test with me and show the results to each other. He said thats fine, as hes negative and gets tested every 3 months anyway.

Now, our appointment is supposed to be wednesday, and now he starts flipping out on me and telling me hes not getting tested with me. I'm freaking out, and I think he's just avoiding the test, as this is a bit unusual.

I want to know if anyone here has any information, or knows where I can get information about the issue. Everything from getting a court ordered HIV test, to possible prosecution by getting a supena of his past HIV tests, to find out whether he knew he was positive at the time of us having intercourse or not.
 
You would have to prove that you were HIV- at the time and that he was definitely the source of your infection, so that would be your main obstacle. The laws may vary according to country and state; in most cases, you would have to prove the transmission was deliberate, which is extremely difficult to prove, vs. reckless. There is often no basis for prosecution if the case is one of reckless transmission.

Anyway, you shouldn't worry about any of this right now. Just go get tested.

agreed with these two. there isn't much of a live controversy here unless you have been infected. alternatively, if it's only your partner who has HIV or refuses to get tested, then it's "only" a personal health and relationship issue that you're gonna have to resolve.

^^^Even if your partner did not test positive for HIV it does not mean they are not infected with HIV. The incubation period can last up to 6 months in which time they can pass it on to other people while still testing NEGATIVE
