When the shit goes down-what to expect?

I think it will prolly depend on where the hearing takes place, if it's in the country then he's in big trouble.

Recently in a well known SE Qld country town, a young guy was at work when police with a warrant arrived at his house to bust him. Due to a tip off, they were expecting to find a small marijuana plantation. They did.
However, unbeknown to the guy at work, a guy who’d recently moved in had decided to do a cook up. As the cops entered the isolated bush house, the cook turned, saw the cop, and dropped a flask on the bathroom floor. It smashed with contents splashing over the bathroom floor. Also found in the bedroom of the guy at work, were three items of interest: a sawn-off 12guage, a semi automatic rifle, and a crossbow.
The house was cordoned off and a Haz-chem team brought it to clean up.
A lengthy interview followed aimed at determining whether the guy at work had any prior knowledge of the speed. It was decided he didn't and he wasn't charged with the speed offences.
His conservative parents (old friends of ours) spent a frantic month arranging legalities and references.
In the end he was fined $2,000 with no conviction recorded. If this had of happened in the city I’m sure all efforts would not have kept this 21 year old out of jail. But in a town where almost everyone owns a gun and dope is common, this is probably close to the norm.
 
If police do happen to raid you and you do get busted with scales only, that doesn't mean anything right? I mean people use scales in their everyday lives.... :|

I'd say they would check for residue on them so as long as you keep them clean it would be ok.
Scales & baggies on the other hand ....

I think you would need a very good explanation for having scales of the decimal accuracy that a distributor would typically use.
Here is a good line to use if ever faced with the question from your local law enforcement agent.– You prefer to load your own high power center fire rifle ammunition and weigh the powder precisely to ensure a one shot one kill return on your investment.

Yeah i reckon!!! i live in sydney and 4 dealers (who dont know each other) and 4 dealers (who deal together) i know all got fucked on by coppers in the space of a week!
 
NSW state election coming up. That may very well explain recent activities there.

If this upsets you read Michael Moores latest book 'stupid white men.' Australian pollies have nothing on the Americans.
 
How about this - one person gets busted could be one pill could be a 1000, he/she shits themselves and names names. Next thing you know 4, 6, 10 people in the same group (sometimes from anywhere depending on who points fingers) have been raided and/or charged. Maybe THAT could explain how groups of people have been getting busted all at once? No must be that time of year - like police turn a blind eye to drug dealing until it gets towards the end of summer or Bob Carr starts dribbling tomato sauce covered sausage roll down his chin.
As for sentence probably looking at 18months or so depending on lots of other things - eg rehabilitation, co-operation with police, amount of money to spend on lawyers, claiming under the influence of a drug addiction, etc. If your friend was smart he should have a lot of money stashed somewhere to pay for all of those things, hopefully it serves as a warning to others who have d-man aspirations.

For anyone who's interested the above mentioned bust-ee had his sentencing yesterday and walked with a suspended sentance!
To the suprise and merriment of him and his family
 
Great to hear. I've got someone close that things happened to that I'm hoping the law is lenient towards.
 
i know a bloke who got busted with a fair few pills, 15 grams of speed. He had been done a fair few times while he was a juvenile, and the cops knew he wasn't gunna change his ways, so they raided him just days after he turned 18. Took over a year till he had to go to court, but he got off with a 2 year suspended sentence, $500 fine and a few hours of community service.
 
Couple of friendly pointers for your mate:

1. Get a great lawyer. They work the system, they are best equiped to deal with it. Legal aid is fine, but better off with a specialist lawyer who has dealt with this area before.

2. Start doing some volunteer work NOW - so your mate can honestly say he has changed his ways, seen the light etc etc. Work with the homeless, barnardo's etc. Good to get references from.

3. Whilst doing volunteer work, try and push back the date of court appearances (makes you look better)

4. If you went to church as a child, go back to that church and get involved - same reasons as volunteer work.

5. If in the ACT, suggest at the first hearing a "griffen bond" - basically a suspended sentance without conviction. Works like this, after X years (1-2 ususally) they hear the case again taking into account what happend (hopefully nothing) during that period of time. If combined with 2,3 & 4 can make you look like an angel.

Anyway, my other thoughts are this: sentance time related to drug offences has been proven to be related politically (my partner did some stuff at uni on comparative heroin / speed convictions back in the 'clean up cabrammatta days' in 1st year criminal law) and E is on the hitlist, so bummer there.

As for the prison aspect, not much to make you smile, but if the nasty stuff DOES happen, he can sue the corrective services department.

Has been kept quiet, but one of my old college freinds worked on a case in QLD, the guy got HIV whilst in prision AFTER informing the gaurds etc that he expected to be attacked, they did nothing hence failed in thier duty of care. Got a big payout, that should cover the cost of his treatment until he dies.

Similar cases in the US have been knocked back, but here in Austalia we are a little more humain.

Anyway, in summary, get a lawyer, do good deeds, express his remorse, try and get a 'griffen' bond-type-thing if they exist in NSW, and hope for the best.

I guess the "first offence" thing doesn't really matter for shit once you've got illegal firearms and 9000 pills...

As far as I'm concerned, he deserves 9 years just for the firearms.

in QLD, expect few months least in prison, or get your mate to go to "drug counselling" even if your mate doesnt want to go, but it will make your mate look better front of the judge as if your mate is "trying to give up drugs/seeking professional help".

They might be lucky to get off with lesser sentence or few months off the prison term if that ever happens. And also helps if you have the drug counsellor with you at the court to speak on your behalf, to tell the judge that "you were trying to give up drugs, and had a lot of problems, blah, blah, blah, more sobbering stories", and try have few family members with you in the court case, so it gives the judge a better "look" at your family and background, but it wont always wont work, all judges are different views and moods.

I know it can work sometimes if you have a very good expensive/drug related laws lawyer, as I know few people done this, and they got lesser sentences.

Thats a fuckin lot of 2-3 pill purchases to be happening inside a club!
People as stupid as that DESERVE to get caught.

SS - your mate was bloody lucky...unfortunately someone I knew wasn't, and he wasn't found with anywhere near as much, and it was also his 1st offence.

It's another year before he sees the other side of the fence.
