[WA] busted. consequences/advice?

If you are found in possession of any amount of cannabis you can still be charged with dealing if there is relevant evidence.

My only concern after reading your story is whether those extra baggies will be evidence of supply. If they are not, then you should not be facing any kind of conviction under the reformed cannabis laws in WA. My understanding is that you can have any number of cannabis infringements - however if you have 3 infringements, you must attend the education session rather than pay the third as a fine. Laws may have changed since I was over there, though, anyone feel free to correct me.

Some more information from the WA Drug & Alcohol Office relating to WA's cannabis laws. Please have a read and remember "This information is intended as a brief guide only. It is not to be taken as a statement of law.".

A Cannabis Education Session is a component of the new cannabis laws. It provides an opportunity for cannabis users to address their drug use and become engaged in treatment.

Growing, selling, supplying, possessing or using cannabis is still against the law because cannabis is harmful.

From 22 March 2004 new laws give WA Police the discretion to issue a Cannabis Infringement Notice to persons aged 18 years and over caught possessing small amounts of cannabis.

If a person receives a Cannabis Infringement Notice, he or she must choose between:
  • paying a financial penalty within 28 days;
  • completing a Cannabis Education Session within 28 days; or
  • having the matter heard in court.

By attending a Cannabis Education Session you will be informed about the harms associated with cannabis use and:
  • obtain information about the cannabis laws;
  • assess the harms posed by your cannabis use; and
  • identify sources for further assistance and support.

Cannabis Education Sessions are available statewide and are conducted by specialist drug treatment services and other approved providers.

Status Report: April 2004 - March 2006

This report examines the first two years of operation of the cannabis infringement notice (CIN) scheme, based
on the first eight full quarters of the scheme, from April
2004 to March 2006. This report is an update of the first
annual status report on the CIN scheme, April 2004 to
March 2005, published in October 2005 and consists of
three parts, reflecting different analyses.

The first part consists of quarterly trends in the CIN
scheme. The second part is a detailed study from 1 April
2004 to 31 March 2006 to provide information about characteristics
and outcomes of those issued with CINs in the
first two years of operation of the CIN scheme. The third
part outlines a number of relevant law enforcement and
health related indicators of cannabis related harm before
and after the inception of the scheme.

A brief overview of the features of the CIN scheme, its
relationship with the Misuse of Drugs Act 1981 (MDA)
and detailed data tables and figures related to this report
are separately published as appendices of explanatory
notes and data tables and figures.

Hi guys,

Well I feel like like a total dickhead.

Recieved a telephone call last week sometime from the officer who booked me. All I will be recieving is a second cannabis caution for $100.

I am so sorry to everyone who replied to this for wasting your time :( I just hope this thread will be useful to future bluelighters.

Panic and paranoia does funny things to people ;) Don't feel bad, DoctorShop, you have every reason to celebrate!!! A caution - woop woop, happy days!! Kudos to you for being mature and polite to the police in the first place, see a little niceness goes a long way doesn't it?

I very much enjoyed reading the responses, and writing some of my own. I hope that information gets cross-referenced to an FAQ or something similar so everyone can benefit from the advice.

Please spread the information to as many of your friends as possible. Everyone has a right to know where they stand.
 
lesson: don't tell cops you have weed in your glove-box during a standard pull-over.
 
In the original post I explained they pulled me over because they thought I was involved in something that had happened nearby involving a car that looked similiar to mine. He was going to search my car anyway because of that reason. It was better in my situation to cooperate.
 
so not a waste of time and so good to hear that the consequences were minimal and in line with the true impact of your so called crime, though truly in line with the seriousness of it all would have been nothing.
