These Drugs Are NOT Legal

All three articles morninggloryseed linked to refer to 5-MeO-DiPT and are prosecuted under the federal analogue act. What about other "research chemicals" such as DXM that probably could not be construed well under the analogue act.
What about unscheduled plants such as Salvia Divinorum and their psychoactive chemicals such as (in this case) Salvinorin A.
While this post and the caution it will incur is well overdue, many questions about the viability of prosecution for the posession of unscheduled psychotropics remain unanswered.
 
Salvia really doesn't fall under the analogue act, as it isn't an analogue of anything. However, on the DEA's website they've tried to claim that salvinorin A is a THC analogue. This is gonna be a court room battle eventually, unless they just go ahead and schedule the plant.
DXM, well, I doubt DXM will ever be illegal. They may crack down on the sale of pure powder to individuals or something, but don't expect them to start jerking robotussin DM off the shelf anytime soon.
 
I don't think the government has ever pretended that they made psychedelics schedule 1 substances because it was for our own good in any way. Nixon associated psychedelics with the revolutionary movement in the late 60's and making them illegal was a good way of getting their own back at the hippies and staving off any more revolt.
