I think they're both amazing but very different films - Id have to say that I prefer the Herzog film though as it has alot more heart and I love the curveball ending. You are right tho change-jug about the name - the film was originally just called Port of Call New Orleans and the Bad Lieutenant name was added to cash in on the popularity of the original.
 
I don't understand the comparison of the old and new films. There are broad similarities between them but I'm pretty sure I remember Herzog explicitly stating his version was not intended as a remake or a sequel. They're unrelated beyond the title. They're both simply movies about a bad police lieutenant, sort of like Lethal Weapon and Rush Hour are both comedic buddy cop action movies.

I thought Harvey Keitel was pretty solid in the 1992 film, though.
