New York is revoking the gun permits of people on anxiety meds

Amherst, N.Y. --- A Buffalo area man surrendered seven firearms, empty magazines, and his pistol permit to Amherst Police last week according to his lawyer. The move was in response to a letter this man received from the Erie County Clerk’s Office that stated his permit was being suspended. His lawyer claims that was because of a new Mental Hygiene provision in the NYS SAFE Act.

Attorney James Tresmond of Hamburg, N.Y. tells 13WHAM News that his client at one point in his life needed anti-anxiety medication in order to get over a fear of going to the doctor for shots or other procedures. Tresmond said his client only took that medication as needed and that he, “doesn’t need it anymore.”

The letter (attached) was drafted on April 1, 2013 and received a day or so later according to Tresmond. He accompanied his client to the Amherst Police Station on Friday April 5th and helped him voluntarily surrender seven firearms.

“They also took magazines,” Tresmond added of the empty ammunition cartridges he had with him at the time.

A New York State Police Spokeswoman would not elaborate on details of this case but did say that, "No one, including State Police, is taking guns from anyone because they are on anti-anxiety medications."

Tresmond said he is attempting to schedule a hearing in Erie County Court to address the suspension and surrender of his client’s firearms. He is also planning to pursue civil action in U.S. Federal Court on behalf of his client. Tresmond believes he sees a number of potential issues dealing with the 2nd, 4th, 5th, and 14th Amendments of the U.S. Constitution. Moreover he believes his client’s health information privacy rights might have been compromised.

“If we lose this thing we have lost everything we hold dear,” Tresmond said of the legal fight he intends to raise over this issue.

The NY SAFE Act signed into law on January 15th by Governor Andrew Cuomo contains provisions to the Mental Hygiene Law that “will help ensure that persons who are mentally ill and dangerous cannot retain or obtain a firearm.” The legislation further states that when a referral on these grounds is made and the Division of Criminal Justice Services confirms the person possesses a firearms license the agency, “will notify the appropriate local licensing official, who must suspend the license. The person’s firearms will then be removed.”

It's shit like this that makes me not seek treatment from a doctor for my anxiety and depression. I'm not getting fucking labeled and risk losing my protection. That would be the day I die. I'll be going out like my founding fathers would expect a real American to. Fuck this bending over and taking everything the government shoves up there.

Good point that fewer people will be more likely to have their illness treated

However, I think generally people aren't around their guns while using alcohol, and anti-anxiety medicine (we're essentially talking about benzodiazepines here) influence one throughout the day, and usually have a very long half-life, at least compared to alcohols.
 
I'd be more worried about when they don't have their "medicine".

Good, sounds like a heaping dose of common sense to me.
This sounds like a good idea? No. This is profiling at it's finest. They should restrict this to people who have severe mental health issues, bipolar, manic, etc. Having a little depression and anxiety shouldn't bar you from owning a gun. I would never think of taking someone else's life in a depressive state. Maybe my own, but that's my business.

That being said....almost all of the mass shootings in America are done by someone on some sort of anti depressants or psychotic. That's what they should rely be looking into
 
Chicago is not an island. Guns can easily be bought in Indiana and other nearby gun-friendly states. Which makes the local gun ban pretty pointless. You either ban them in the entire nation or not at all.

You are very right. But how many law abiding citizens are going to risk doing that? Not many. They could possibly even get a trafficking charge if they got caught. But say a criminal who doesn't happen to have a felony decides to do this, who do you think he is going to sell these guns to? Criminals.

This is fucked up IMO, but the people of the state of New York like a big overreaching government, so it's their prerogative to do this I guess. We can do things differently over here. *casts leery glance towards San Francisco*

Tombstone, AZ with its gun loving, open carrying populace, has a higher crime rate than the national average. Why is this if more guns makes us safer?

One thing that I see happening in Florida--which is full of guns--is stick-up kids initiating the robbery by shooting the victim in the face, even if only to take their chain or wallet. I guess because they expect the victim to be armed. It doesn't make much sense to me because cops will spare no expense to investigate the murders of innocent people, but teenagers today are really stupid.

I will agree that a lot of teens these days are stupid and shouldn't have a gun. But most of what your tAlking about could be avoided if someone would teach kids from an early age how to handle and respect guns. Switzerland anyone?

I live in New York, friend. Whereas you live in Cali. Take my word over that article, us NY'ers do not want an overreaching government. We are extremely proud and supportive of states rights and individual freedoms.
 
Some anti-anxiety meds can lower inhibitions. This, combined with the patient caught in a distressful, possibly traumatic situation *may* cause him/her to seriously injure or kill nearby people if they have access to a firearm.
