Morning everybody.

The Trump Presidency is over. It has passed noon EST, former president Trumps term has officially expired and he is now out of office. And I just watched president Biden take the oath.

But Trump is likely to keep being a topic of interest through this coming year, to that end, our lovely CEPS mods have kindly given me the honor of getting to be the one to update the threads for the new year!

Normally we would have locked the 2020 Trump thread by now, but because of the election it was left open until the inauguration. That time is now here and I have just closed the 2020 Trump presidency thread.

In the interest of respect to the by no means small number of Americans who voted for Trump, after some discussion we have decided to call this the former president trump thread. In deference to the office that he held for better of worse.

Please now continue your regularly scheduled rantings. <3

And it has happened. The first and possibly only term of the 45th president is over. This 2020 thread would normally be closed by now but we decided to wait until the end of the term, now that that has happened, this thread will be closed, further Trump discussions can be held at the following...

We still have the impeachment. And it's trump he will hate that he's not the center of attention and will try and like a toddler he will make more and more noise until he gets attention again.
 
Negative ions create positive vibes. He has Rudy to defend him. Due process and such. Has he been charged with a crime yet?
 
Impeachment is a political process. There is no due process because there's no possibility for criminal sentencing.
You're guilty if the senate votes that you're guilty, it doesn't matter what the evidence is or even what the charge is.
 
Like a war crime or something? I would say disturbing the peace or public nuisance which would be a misdemeanor and removal from office. But u kno I feel we should focus on ending the fed.

No there doesn't, It's pretty much entirely up to the senate how they conduct it the trial.

If they decide he's guilty, he's guilty.

Impeachment is a political process confined to the legislative branch, It's not a legal or judicial question.

What is a high crime that can be impeached is decided by the house of representatives, and if the senate agrees, that's pretty much it.

Probably no point. He can only pardon pending (or suspected future) federal charges, he can't stop the state charges and more pressingly he can't stop the impeachment.

Same reason as before, because it's a political process.
 
Yep. If presidents could pardon impeachments impeachments would be entirely worthless as the primary way of holding the president to account.

I know what the constitution says. And I'm telling you that impeachment is a political question.

What constitutes high crimes and misdemeanors in this context is entirely up to congress, it's not a legal question and it requires absolutely no evidence.

It's for congress to decide if the president has committed a 'crime' deserving removal from office. It carries no legal consequences beyond removal from office and the ability to hold office. It is not a criminal charge. There is no right to due process, there is no right to a jury of your peers.

If congress says you're guilty of a crime deserving removal from office. That's final and they aren't required to explain their reasoning.

Congress is the foremost institution representing the people, that's why it is up to them.
