Office drug death sees charges laid

Two men have been charged with manslaughter after failing to call an ambulance for a woman who fell ill after taking drugs in Sydney's inner-west, police say.

The body of a 28-year-old Victorian woman was found by police officers in an office on Cook Road, Marrickville about 7am yesterday, police said.

Police said a 31-year-old Marrickville man and a 37-year-old Strathfield man were taken to Marrickville Police Station where they were interviewed.

Both were charged with manslaughter, police said.

Police said the Strathfield man was also charged with supply of a prohibited drug.

It was alleged by police the woman was given a prohibited drug and the men failed to alert emergency services when she fell ill before them.

A post-mortem would reveal the type of drug the woman had taken, a police spokeswoman said this morning.

It appeared the woman had moved to Sydney recently from Victoria, she said.

An ambulance had been called by police, however the woman was dead when its crew arrived, a NSW Ambulance Service spokeswoman said.

Both men were refused bail and will appear at Newtown Local Court today.

Now I know you should always call ambos if someone gets sick, but I never realised NSW had allowed people to be charged with manslaughter for inaction.
 
Doesn't seem fair, these two get (rightly) charged, and yet an elderly bloke got killed by a cyclist who went through a red light in Melbourne the other day and all he got was a fine for going through a red light.
 
It says they were charged AFTER failing to call the ambulance, rather than FOR failing to call it....Perhaps the manslaughter charge is due to the fact that they supplied the drug in the first place?

Surely there are more factors than just failing to call an ambulance.....

Its pretty low to do that to someone. If a mate/aquaitence/anyone, started oding you'd have to be fucking stupid not to get help, ambo's aren't the cops.
 
I'm wondering if the reason they were charged was because they gave her the drug with the intention of date raping her?

Sorry if it seems I have no faith in humanity; but I dont have any faith in humanity, so it comes out that way.
 
^yeah report does sound a bit sus, maybe because it tells fuck all, or maybe because there were some more disturbing aspects to the incident and they can't reveal more.

Two men charged for 'inaction' after overdose

TWO men allegedly left a women alone for more than 24 hours in a Sydney office after she overdosed on a lethal cocktail of cocaine and speed, a court has been told.

Victor Henriques Pestana, 31, of Marrickville, and a second man have been charged with manslaughter after allegedly failing to seek medical attention for the prostitute known to them as Cleo.

Mr Pestana was granted $10,000 bail in Newtown Local Court today. His co-accused, a 37-year-old Strathfield man, will face the same court this afternoon.

The woman's real identity is Jo-Anne Bowen, a 32-year-old from Victoria.

According to a police facts sheet tendered to the court, the two men met her at the co-accused's office on Cook Road, Marrickville, in Sydney's inner-west, on Tuesday about 10.30pm (AEST).

The men had previously met Ms Bowen at the Gateway Brothel in Petersham.

Mr Pestana told police that he and the co-accused did not have sex with her, but that they consumed cocaine together and that he injected Ms Bowen with a mixture of cocaine and water.

He said Ms Bowen was in a hyper-active mood and dancing around the office before she asked for more drugs about one hour later.

Mr Pestana told police he did not want to inject Ms Bowen but she said she could not do it herself.

After another hour she asked for more but Mr Pestana said he refused because she had already consumed speed.

He said he walked out of the room and when he returned he found her injecting herself.

She then immediately went into a fit, but Mr Pestana told the co-accused that they did not need to call an ambulance.

Ms Bowen eventually fell into unconsciousness and Mr Pestana told the co-accused that she was sleeping, according to police.

Mr Pestana then went to sleep on a lounge in the office while the co-accused continued drinking alcohol near Ms Bowen as she was dying.

Police said the men realised she had died several hours later when Mr Pestana awoke. They agreed on a version of events and did not return to the office until 7am (AEST) yesterday.

Police charged both men with manslaughter because they did not call an ambulance for the woman.

"It is alleged by police that both the action and inaction of the accused and co-accused showed such disregard for the welfare and life of the deceased, and further that the death of Jo-Anne Bowen was a direct result of the failure of both the accused and the co-accused to seek or render medical assistance," the police facts sheet said.

Magistrate Sue Seagrave adjourned the matter to be heard at the Central Local Court on September 7.

TWO men who allegedly watched a woman die from an apparent drug overdose and failed to call for help for about 30 hours have been charged over her death.

A Marrickville painter, Victor Henriques Pestana, and his employer, Dennis Tsokas, are accused of the involuntary manslaughter of Jo-Anne Bowen, 28, in total disregard for her welfare and life.

Police allege Ms Bowen, who met the men at the Gateway brothel in Petersham, had taken cocaine and methylamphetamine with them on Tuesday evening at Tsokas's Marrickville office.

According to a document tendered in Newtown Local Court yesterday, Pestana, 31, told police that after Ms Bowen had taken a third injection of cocaine she suffered a fit and fell to the ground. Tsokas, 37, wanted to call an ambulance but, after arguing, the men did not summon medical help, Pestana told police.

When she became unconscious, Pestana told Tsokas she was sleeping. Pestana told police he then went to sleep in another room, leaving Tsokas drinking alcohol while Ms Bowen lay on the floor.

When Pestana returned several hours later, the men eventually agreed Ms Bowen had died. They discussed what they should tell police, then left some time on Wednesday morning.

They returned at 7am on Thursday and called police. After initially denying knowledge of the death, the men allegedly admitted taking drugs with Ms Bowen.

After being told of forensic evidence, Pestana made a statement. He allegedly admitted that he failed to monitor Ms Bowen's vital signs or seek medical help when it was clear she was not recovering.

Police say Pestana was distressed and realised he might go to prison for a long time. He was granted conditional bail yesterday and ordered to reappear at Central Local Court on Thursday.

Police alleged Tsokas told them he used cocaine with Pestana and Ms Bowen, but was not there when she overdosed. He was also granted conditional bail.

Man pleads guilty over woman's overdose

A man has pleaded guilty to manslaughter following a woman's fatal drug overdose in a Sydney office last year.

Victor Henriques Pestana, 32, of Marrickville in Sydney's inner-west, was one of two men charged following the death of a 28-year-old prostitute in August 2006.

Pestana appeared in Downing Centre Local Court on Thursday, where he was accused of failing to "seek or render vital medical assistance required by Jo-Anne Bowen who suffered a fatal overdose".

He pleaded guilty and will be sentenced in the Downing Centre District Court on July 20.

His co-accused, Dennis Tsokas, will next appear in the Downing Centre Local Court on September 14.

On the one hand they charged that bloke over supplying drugs (ecstasy?) to his girlfriend after he called an ambulance, and they charge another bloke for not calling an ambulance.

What is the message to people in future situations?
