Got a lawyer?

First and foremost it depends on you cash situation. (PS there should be a handcuffs or scales icon for these threads)
Legal Aid is means tested unless you are under 18 (i think), so if you have a shitload of assets (eg own your own house, cars, etc) you may find it difficult to get their free help.
Further the amount of time, skill and resources that get spent on getting you off is usually proportional to the amount of money you can afford. An example - you get busted for minor possession (eg 1 or 2 pills), to get a lawyer to follow the case through for you will probably cost in the vicinity of $1,000, again dependant on city, firm, etc. Legal Aid and the like are free, and while they will do their best for you, they are using the resources that are shared between all, and the time spent on your case will subsequently have to suffer.
If looking for a good lawyer a good place to ask (if you can't be recommended by someone) would be the law institute as stated above, the council for civil liberties in your state, or call legal aid, and if you aren't eligable, they can recommend someone to you. Failing that hit the phone book, most firms list their specialities.
A note - the big law firms you see in town usually DO NOT specialise in criminal law (well not the minor drugs possession criminal stuff, more like white collar crime) so they may not be the best port of call. Criminal law firms are usually specialist.
Further to BT's points above about listing firms - i can guarantee very few firms would like to be associated with a message board on drugs, and the whole of bluelight might not be the clientele they are aiming to entice.

I was told (after getting done for silly things not drugs) that I should keep a card and even found out some lawyers work part time for legal aid or something like that so don't know if this means they still use their own firms resources or not but? ... I don't carry the card but have thought of it many times
 
It can be very expensive to call a lawyer late at night, I would just ask the police to put me in the cells for the night and get a good sleep before calling one. This also means that you have time to compse yourself before being interegated, which wouldn't be fun to go through at 4 am. After all, the cops simply cannot interview you without a lawyer if you request one, and if you can't afford it then you are under no obligation to work on their time-table. Personally I think that unless you are dealing at high levels then it would be kinda pointless getting a lawyer out of bed, after all you would have to be a king-pin to afford it. Also, on a side note, I would never get a legal-aid for a serious offence, they are quite often two-bit lawyers and if you are serious about defending yourself then a good lawyer is worth his (or her) weight in gold.
 
i think the best thing to do would be to get a whole bunch of friends over and brainstorm what you would do in the situation, then nail out the details and odds are only one of you will get caught ever if at all and you'll be prepared. have the cover story ready, yeah i reckon you are going to need one, find a law studnet to run over it, read the laws of the land, check it twice, then write it all down and stuff it in your wallet. every now and then take it out and refresh your memory. i think its as importent as taking 5-HTP post roll. its all harm reduction. even if you wait for your lawyer, u will b mentally prepared, but make sure you act ignorant about it. its probably the only viable answer. i mean, come on what, other reason would you have for pills on you.....a smear of someone elses DNA or hair might also help, just pick it up of some keyboard... someone slipped it too you to frame you when the cops busted in..... though i dont reckon theres a way out of getting caught actually buying the shit... your up shit creek without a paddle... and notice how all the gumpies on tv cop shows always end up talking and give themselves away
 
^^^^ damns thats stupid, the cops will look though your wallet and find it, i would say eat it, but you should of eaten the pills if you had the chance
 
Wouldn't any lawyer be better than no lawyer? They have what many of us on here don't and that is a law degree. It is an interesting thread though, made me think. It could be a good idea just to know what to do in the case of getting caught with anything, must remember, you can be done for possession even with the smallest amount, they are illegal substances we are talking about here.

I would have to disagree with that. Back many years, I had to goto court for something that was semi small (basically a few trumped up charges along with underage drinking). Our family lawyer said it would have cost too much for him to handle for something so minor so we went with a legal aid lawyer. By time the initial case was finished, I was looking at a criminal record, big fines and a ruin to my future employment career. The lawyer was absolutely horrible and did nothing for my case. I didn't even get to have a say with the total bullshit the police had said in the case. Basically they said I had attacked police, using vulgar language and just made me look like a scum bag. Anyway, we appealed using our family lawyer (which still cost us a small fortune anyway) but managed to get the conviction squashed, record clear and the police apologising to me after court and wishing me well *spit to the two faced pricks*.

Make sure you get a good lawyer as first hand + several friends experiences, a bad lawyer is just as bad as not having one.
 
Yeah I got done shoplifting when I'd just turned eighteen, the crappy legal-aid lawyer I had got me a convivtion :X When I had to go to court for an offence years later the magistrate said he wouldn't have convicted me if it weren't for the earlier conviction. My lawyer was appalled that the legal-aid lawyer I'd had in the past hadn't got me off that charge.

Oh and I just realised that this is an old thread and that I posted here twice saying basically the same thing 8( D'oh!
 
This thread made me think (hard sometimes ;)), I really should have a lawyer's number on hand as you never plan to get busted or caught with any amount of anything.

I think I'll have to bring this up with my friends and get organised!
 
I met my lawyer in a chill out room... Have never had to use him and never plan to, but its always nice to know someone "just in case"

Hopefully when I need him he won't be locked up himself :p
 
Get a Lawyer!

I was recently arrested in N.S.W on 2 drug charges and resisting arrest/assaulting a police officer.

My advice to anyone who has been arrested is to SAY NOTHING and call a Lawyer. Trust me. Anything that is said can be written into the issuing arrest statement/police report and that is whats presented in court and you have to defend. From the moment the police catch you, anything you say at all can be used against you. I Promise you will be amazed at the detail of a police statement. They write what you said/they said to the exact word.

Also, from my first time (extremely scary) experience, Police really do try and make you crack anyway they can. They use any scare tactic possible to make you say something, or drop yourself in it deeper. Just keep quite, be polite and answer, YES/NO/OK/NO THANKS/ - Talk as little as possible.

DON'T SAY ANYTHING TO THE POLICE - NOTHING. ZILCH. NILL. NONE.

Also - My advice would be look, if your in trouble, look sincere, but don't look as though your a frightended, drowned rat!... Still look confident and sorry, but not "I'm scared shitless of you" because they will most defiently see your weakness and try even harder to scare the shit out of you.

Tell the Police you don't wish to be interviewed and you want to call a Lawyer. THIS IS YOUR RIGHT.

One thing I remember this police officer saying to me was that if I declined to be interviewed, and it went to court and I was proven Guilty, I would recieve a much harder sentence - BULLSHIT! - I checked with my Lawyer, and that was yet again the Polices SCARE TACTICS.

The Police know that once you've lawyered up, its much harder for them to prove your guilt, then if they can just walk you into an interview and make you slip up somehow and have you on tape!

BTW - Lawyers are fucken expensive! Haha.. Mine is costing $500.00 an hour. I have now taken it apon myself to go to court and do my own adjourments, and only involve my Lawyer when I need him there!

hmm, I've never actually thought of this before.. I'm lost as to how I'm going to find the number of a decent lawyer though..
 
As said above...if you are actually arrested say literally nothing...there is nothing you can say that is a good thing as every single thing that is said restricts your options and confines what you can rely on at a later date...once they have gone to the length of arresting you they are going to try and press charges regardless of how good a stroy you concoct. If they ask how your night was, say nothing. If they ask you what you've been up to, say nothing. If they ask you what the time is, say nothing. If they ever want to search you or do anythign else like that say you want to immediately consult w/ a lawyer and they are obliged to get you one as soon as reasonably practicable. You don't want legal aid representing you in court, but theres no problem having a chat to a lawyer on the list. Ask for a right's lawyer.

If you have not actually been arrested yet and it seems borderline and you think you have a REAL chance of getting off, then by all means blabbermouth as this is the only chance your gonna have to sweet talk them, but always keep in mind if it fails your gonna have problems w/ anything you've said, so don't get too extravagant.

I have good knowledge of NZ law and reasonable knowledge of Aus. law w/ the ability to do proper research so if anybody ever gets into a bit of a pickle Im only too happy to try and help out. Will be happy to lend my free services to Bluelight once Im accepted to the Bar - will probably end up living in Aus. and I fully support the work you guys do

i'm another one and always happy to help out. i even have a few matter dealing with possession of pills as well so i know a bit.
