California Legal Marijuana in a Hotel

I have a cannabis card, and it's legal for me to smoke.
I recently went to a hotel (smoking room) , and no where in the policy does it say that you can't have Medication, it does say against drugs , but not medication, and I have all of my papers for my Diagnosis, my cannabis card, and the paper they gave me when I first got my card saying that its from a physician.

Now, they are trying to charge me 250$ for having Marijuana in the room, when "I" never signed ANY papers. And I didn't see anything at all saying I can't have my medication or even Marijuana for that matter.

So, should I go about fighting this in any particular way, I know in California it's legal for me to Carry 16oz of marijuana without penalty as long as I keep it in my trunk and don't smoke in public, well, when I rent a room, I assume that it's a private room (meaning, the rooms not open for people to come & leave as the please, it was locked and had a do not disturb sign, I smoked two joints, ashed them in the ash tray, and threw it in the trash the next morning when it cooled down.
 
There might be marijuana freedom organizations who could help you fight this.

What's the $250 charge? Something the hotel is trying to make you pay? Or did you get some sort of citation?
 
To me it sounds like you smoked in a room that was no smoking. The $250 charge stemming from you making the room smell like smoke. That's what it sounds like to me.

HOLY FUCK 8o 16 oz? I had always assumed that you could legally carry much smaller amounts (like an oz at the most) in California with a cannabis card, but 16 ounces??? Wow, I am so moving to Cali.

And, they might as well fine 750$ me for having blood pressure medicine, suboxone and ativan prescribed to me.
I mean, I use weed for sleep, I have been diagnosed with sever insomnia , and I have a paper with my diagnosis, I have my card, and my file(paper with phsyican signature saying I can smoke)
I haven't been back yet to speak to them about the 250$, but I REALLY don't think I should be charged for this when all I did was smoke two joints and goto bed , I mean, I didnt tear up the room or anything, I put my ashed in the ash tray, emptied them to the trash the next morning, and yet they are kind of treating me like a criminal when I literally wouldn't have been able to sleep if I didnt smoke...
 
And sorry , I would edit my post but its not there, but, the lady at the front desk basically told me that I have to pay 250$ from someone finding weed in the room (guessing the maintenance / maid )

They cannot charge you this. This is fucked up.

I have smoked weed in tons of hotel rooms which were non-smoking. No one ever said anything to me about it. There was one room which had a $250 fine as well for any smoke, and I did it anyways because I never signed the paper! They just gave me the room key and didn't even notice I didn't sign, interesting huh?

Anyways - it's a legitimate medication, they can't charge you for it. They can't make up rules that aren't written and set in stone before you started your stay there.

I would contact an attorney and sue them if you have to, in case they already are trying to bill your credit card that.

And if they are, tell your credit card you did NOT authorize a $250 surcharge, and that they are strictly scamming you/hassling you.

You could even go into detail to your credit card company with every reason about how they are just trying to scam you!

This really is a scam, I feel like you need to point this business out to the world and tell EVERYONE not to go there.

Where was this hotel?

definitely speak with a mmj oriented attorney or organization, or 3. they may be interested for their own "claim" to the case.

if you fight this, and win under the circumstances of you being only a person using their medication... you would win the same case for others to come, by reference.

but, i think they will be able to get away with charging something... :\
claiming which is plausible -that the room needed to be "fumigated" or w/e, by a hired service possibly for the comfort of the next leaser, avoiding calls to the desk inquiring, and the hotels reputation.

It was a smoking room, 5th floor, never left my room, and I didnt sign any papers saying that I can't.

I made sure it was a smoking room, they are trying to charge me 250$ just for finding weed in the room (which I emptied the ashes into the trashcan the next morning after I had woken up and got ready to leave)
 
Alright, this was also at a Casino/ Hotel.
The room was smoking , I know that all of the rooms with odd numbers (Hallway to the left is odd, hallway to the right is even , and all were smoking rooms,
I feel like I'm getting ripped off here because not only was I using it for medication, but, I also had Clonidine for blood pressure, subutex which Ive been on keeping myself away from opiates,
Makes me wonder what they would have said if they found half on a clonidine pill in the trash (OH 250$ CHARGE!)
And it was a debit card, and they took the money about a week ago, maybe two, I was trying to figure out what to do but seemed nothing showed up on this thread for a week or two.

Hah, yeah, pretty much , 16 ozs of weed and 12 plants, 6 flower , 6 veg.

Ofcourse that night I probably had 7 grams or less, but , what ever,
Ill be going back there and getting the money back, And if they want to put up a fight Ill ask them where it says In fine print that I can't smoke "Medical Marijuana" because if they wan't to play the "No drugs" card, well, I want to ask about people who bring in medications, those are ALL drugs, but I don't see them getting a 250$ charge for accidently leaving a pill on the dresser or something, but I smoke, and put everything away in the trash the next morning and I get in trouble? shit, thats a joke, I didnt even come out of my room once.
Guess Ill be going back soon, and Ill post back and let you all know if they want to fight it in court or just give me my 250$ back.
 
^ You can call your bank and tell them you did not authorize the transaction. They should refund you the money, issue you a new card, and start an investigation. Banks have badass lawyers, so if the hotel did in-fact wrong you, and the bank gives you back your money - guess what - the hotel has wronged the BANK and the BANK's badass lawyers WILL take care of it.

I had a similar thing on spring break. Some hotel charged my card $100 for no reason at all, just charged the extra $100. The bank took care of it (and probably sued the hotel for attorney fees and who knows what else). Just wondering, how old are you? I found that a lot of places think they can screw me because I'm 20 and don't know any better 8)
 
Have you explained that it was for medical use? Ask them what exactly the charge is for. Say that it is legal for you to have marijuana on you.

I'm kinda confused with what they are actually charging you for ...
 
I think you should dispute this charge as well. But you have to do it right away. If you wait too long (either 30 days or 60 days, I don't remember, and it may depend on your credit card issuer), it will be too late.
 
I do not believe that there can be full expectation of privacy while occupying a property that is not yours. I would not be surprised if you signed something that said if they suspect anything illegal they can open the door and search.
