Drug Maker Will Soon Hold Patent On THC, CBD As Cancer Cures

GW Pharmaceuticals, a drug company that specializes in cannabis-based pharmaceuticals, has received early approval on a patent covering the use of marijuana chemicals for treating brain cancer.

GW Pharmaceuticals announced Wednesday that it has been issued a Notice of Allowance from the U.S. Patent Office for a patent application involving the use of THC and CBD, the two main chemicals in marijuana, for treating gliomas.

Once a patent application is deemed a genuine invention, the Patent Office sends a Notice of Allowance that outlines the fees involved with final approval.

Specifically, the company provides this description of the patent:

“The subject patent specifically covers a method for treating glioma in a human using a combination of cannabidiol (CBD) and tetrahydrocannabinol (THC) wherein the cannabinoids are in a ratio of from 1:1 to 1:20 (THC:CBD) with the intent to reduce cell viability, inhibit cell growth or reduce tumor volume.”

Filed in 2009, GW’s patent application lists Otsuka Pharmaceutical as a collaborator and initially claimed the invention of the “use of a combination of cannabinoids in the manufacture of a medicament for use in the treatment of cancer.”

However, it’s likely that the application was revised since then to be more specific in its claims, including the ratio of THC to CBD used and the type of cancer treated.

Indeed, the use of cannabis and cannabis-derived chemicals to fight a wide range of cancers has long been suggested by pre-clinical research as well as anecdotal reports.

On the other hand, the first clinical trial to investigate these cancer treatments only began last month, launched by GW Pharmaceuticals for their cannabis drug Sativex.

The trial investigates Sativex in combination with the standard chemotherapy drug temozolomide, and involves 20 patients with recurrent glioblastoma multiforme (GBM), an aggressive and rare form of brain cancer.

GW Pharmaceuticals also announced in November that it had begun human trials of a CBD-rich cannabis drug for the treatment of pediatric epilepsy.

Mixed feelings about this. Really glad that the plant is being used to its potential. Wary about big pharma getting all over it. As much as you can grow your own. CBD rich cannabis is not something that is on the market much and people like tony bower are getting locked up

I think the idea is some ratios will be more effective/tolerated by different people.

I feel like this can only be a good thing. It will really show the general public just how powerful and useful cannabinoids are, from an official source and with clinical trials supporting it. Let's just hope this doesn't lead to any ridiculous situations where GW tries to use their patent to restrict the sale of plant matter for medical uses.
 
It would make me vomit to be asked to pay big pharma a cent. Im off to the patent office to patent every natural known chemical that comes from plants that have been used to treat illness for thousands of years.
 
This will likely be a bad thing I anticipate. A pharma company could monsanto the situation and say that weed growing violates their patent, giving them license to charge you a IP fee for growing your own medicine.

No one ever got sued for growing poppies, and pharma has a hell of a lot more invested into poppy derived opiates. I can't even imagine a legal scenario where this would be trouble for normal growers. If you're growing, selling and promoting your product as a cure for brain cancer then things might get interesting.
 
Not comfortable with this, but then, I'm not really comfortable with anything the (absurdly corrupt) pharmaceutical industry does.

I agree, but the whole range IS need to treat cancer, so if the gov't is trying to hand this over, they have to include the range. They'll need higher THC than 1:1 to treat cancer too, as high as 10:1 to 30:1.
 
Who says they will? The fact that it's legal in four states and basically legal in california and several countries means it will be looked at differently. It's not like someone will reprimand you because "THC is owned by GW". They're definitely not patenting a plant, just specific ratios of cannabinoids.
 
Fuck these motherfuckers. Copywrite law needs to be rewritten entirely.

I consider this a form of blasphemy. Patenting one of God's gifts.
