AN Irishman suing a New South Wales council for negligence after breaking his neck while swimming smoked marijuana on his holiday in Australia, a court has been told.
Lawyers for Coffs Harbour City Council said the admission in a travel diary that Garry Mulligan and his girlfriend Jennifer Brady had "smoked joints" revealed Mulligan's attitude to the law and to following directions or warnings.
Mulligan is suing the council for not providing any warning signs at Coffs Creek, on the NSW mid-north coast, where he hit his head after diving into the water in January 1999.
The 33-year-old former train driver is now paralysed from the chest down.
Mark McCulloch QC, representing the council, questioned Brady about the entries in her diary. While she said she did not recall smoking marijuana, she agreed with him that the diary was "not a work of fiction".

Oh no! Smoking a joint shows how you have contempt for the law and don't follow directions of dangers?? what _exact_ dangers do they mean? A few joints here and there lead to a life of crime? He deserved to get paralysed? Maybe they lead to instant death?
