Warrants from State to State.

Hey guys, I have some big things coming up in the next few months, something i really don't want to have to deal with. I'm thinking about just bailing the state. I dont know how far a warrant follows you but do they still go state to state, ect? *edit* also, what about from county to county. i am planning on moving to a different county in a few month anyways. also- does it matter what kind of warrant it is, whether it be felony or misdemeanor ect.

Misdemeanor - if you're talking about counties, I'm guessing it's a misdemeanor....

Why would you RUN from a misdemeanor?

I'm facing 6 1/2-9 years for a crime that's... well... stupid to be honest.
I'm not going anywhere.
Why?
6 1/2-9 years is NOTHING compared to a lifetime of running and looking over your shoulder.

And your punishment will be MUCH greater if you're ever caught.

You don't want to run...
If you're out on bail and ASKING stuff like this, you're not up against anything BAD.

You either don't have money for a decent attorney to ask this stuff.... because you posted bail - if it was BAD, bail would have been insane, and you'd have gotten a better lawyer rather than bail...
So... it can't be that bad...

Fess up, deal with it, and make it go away.
 
its a felony charge of drug possession. im not asking to get a lecture, and im not asking how to break the law. im asking how warrants work from county to county, state to state, ect. thanks guys.
 
If its a bench warrant then your screwed. Anytime you get pulled over, they will know about the warrant. The longer you let it go the worst it gets, so get yourself a good lawyer and plead out your case if you don't think rehab or community service will cut it. Hell, try the military route. gl.
 
i'm getting charged with possession of a controlled substance, delivery of a controlled substance, paraphenalia, and reckless endangerment (i put the needle in someone's arm that O.D.'d and i called 911.)... i have many previos drug charges and a previous reckless endangerment charge also. i dont have any warrants yet, thats months away, im just trying to look at all my options. it doesnt sound like running to a different state or county will do me any good however. sigh. this is what i get for making the call to try and save a friends life, they search my house, blame it on me, and charge me with everything possible.

Possession, or possession with intent to sell?

I don't know much about warrants, but a federal warrant for your arrest will have them calling you to set up a meeting, then you being ambushed my 20+ people with guns.

If it's simple possession, give me amounts, I'll calculate your offense level (felony/federal, yes?) for you and we'll go from there.

I can't recommend running or pursuing the path of determining how to avoid getting trapped in a warrant...

You'll regret it when you finally get caught...
And you will...
When you apply for a credit card.... get approved for a car/house loan.....
ETC...

You can't LIVE in today's world with a warrant.
Every day that passes, the federal and local databases get merged a bit more.

You may be fine for a while, but it won't be worth it in the end.


Let go of this futile thought pattern and let's focus on building you a defense and figure out what's most likely going to be requested as punishment.

There are always pre-trial diversions if it's a simple possession charge and it's your first offense...

Don't give up hope yet.

Computers dude! If you ever get pulled over,or arrested for something else,example- a traffic stop,its procedure to ask for your I.D then they run it through the computer,then bam! busted! and what ever you were facing in the beginning,they will tack more time for running.plus,its not fun looking over your shoulder the rest of your life.
 
i dont know i just talked tot he detective yesterday. he told me all the charges they were thinking about filing. since i had the heroin in 4 or 5 different bags (it wasnt more than 3 grams thoug) and he found a scale wth white residue somewhere else in the house too, it looks pretty bad.basically, this was the situation. got drunk with my room mate, she decideds she wants to try shooting for the first time. fast forward. anyways, she told the cops that I was the one that stuck the needle in her arm. I wasn't. she told me she wasnt feeling anything at all after she banged about a half of what was in the needle. I told her to let it sit for a minute and we'll see how she feels then. I go to the bathroom, and come back in a lil less than 5 minutes (i couldnt get myself to pee, lol) and her head was slumped back, the needle was gone (she did it all) and her lips were blue. I called 911 instantly and started gving her chest compressions, and helping her breathe. she gained the color back in her face. i didnt have time to hide the drugs or do anything like that, i wa saving a friends life. anways, the police threatened me they w0uld take me to jail that night if i didnt consent to a search, and i needed to stay home so i could go visit my friend in the hospital. so i agreed, they found everything. anyways yetesrey i wen to talk to a detective and they say its for sure possession of controlled substance, delivery of a controlled substance. the ones not for sure is a reckless endagerment charge. because supposedly i stuck the needle in her arm, i endagered her life. Im scared of this because i already have 1 reckless endagerment charge on me. I also have many drug charges. can anyone give me some hope?

So it really depends on your prior history level.

You do, however (technically... if you request them) qualify for downward departures for your cooperation.
You were seeking help for an OD - you can play that on the jury if you get to trial (I wouldn't... plea out, you'll be better off... get about 1/2 the time...)...

It really depends on the prosecutor...
Since you have priors, you're probably not gong to get off completely...

You're not looking at a significant amount of time though... I'm willing to bet less than a year if you plea.

I was thinking a month being the maximum time, lol. my attourney was telling me something about drug court, how that could help me also.

If you have state charges at a felony offense level....
I dunno if that stuff applies or not.

I was picked up by the FBI in Feb....
The quantity I had would usually be a state offense, but there were extenuating circumstances involving one person in the conspiracy that turned the whole case federal.


State charges COULD be different...
I don't know how the sentencing guidelines apply to the states (if they do at all).

It's the only state with OD protection clauses where you can't be arrested or charged for reporting an OD...

I don't think you can have the charges switched from one state to another - and the drug court thing - that's probably specific to your state so you may not want to flee anyway.

But.... Drug court.
If the lawyer brought it up, ASK FOR IT.


If the charges ARE Federal... you're looking at 10-16 months for the first offense simply for POSSESSION of heroin.
1 microgram of heroin, cocaine... basically... any schedule I substance except for Marijuana... puts you at level 12 because those drugs are "SOOOO BAD!!!!"
10-16 months.
Level 12 is the lowest you can get for any of them.

Hope they're state charges...
You'll be way better with them.

State charges are usually quite different, and the federal sentencing guidelines do not apply.

I went to a federal court for my bail hearing.

What makes it federal?

As far as I know, the arresting agency and the plaintiff.

In my case, it's the USA.

In yours, it's probably your state.

You have a copy of your indictment?
 
i dont have a copy of anything, i dont even know what im being charged with for sure yet. i met up with a detective yesterday and they booked me and released me, and he said it will be a while untill i get anything in the mail, and that another detective.. a narcotics detective would contact me, im just sitting here worrying and waiting. saving my moneyand consulting my attourney is all i can do right now. im also on probation so this will come up as a violation once it gets put through on the computers i guess? i dont really know how any of this works. i just know i'm so fucked.. and im stressing so bad i cant get to sleep at night. if anyone here has some real legal knowledge and could help me out via PMs, please PM me. i need someone to talk to :(

I tell my Pre-trial Services officer (PO equivilent... kinda...) more than he cares about.

I got a ticket for having expired tags...
Wanted to talk about it for about 30 minutes... he kept rolling his eyes and telling me it wasn't a big deal...

Until you have an indictment I don't think there's anything you can really do...
Your charges are at best completely ambiguous, and could fluctuate dramatically by the time formal charges are filed.

As for the PM thing...
Go post-whore in the welcome thread... There's always people there to talk to in a more lighthearted manner.

Ok in the USA warrants only go nationwide on the NCIC, and they are put on there by the state the warrant is from. Felonies almost always go on, misdemeanors almost always do not. There are also special cases for crimes like violent murder and other serious shit. Which means if your charge was a misdemeanor you are safe as long as you stay out of the state the charge is from.

But since each state handles it differently you get differences, like maybe some states don't bother getting low level felonies added, and some get everything even traffic warrants added even if they have no intention of actually extraditing you should you be caught.

Remember also extradition is expensive, no state is going to pay to extradite you over a misdemeanor unless you are caught right next door or something.
The farther away you are the less likely they are to extradite even for low level felonies.

Canada has access to the NCIC I believe, running to Canada won't help they are too meshed with US law enforcement. You'll get nabbed at the border if you are wanted for something serious. Any other country you're pretty much in the clear, unless interpol gets involved!
