Indonesian prosecutors want 12 year sentence for Australian man arrested for smoking a joint and possessing less than a gram of marijuana in Bali

Bali prosecutors want an Australian man allegedly caught smoking a joint on the beach to serve up to 12 years in jail.
Nicholas James Langan, 24, from Townsville, was arrested about 1.00am on January 27 at a beach in Canggu, north of Kuta, for smoking a marijuana joint.
Police seized the 0.1 gram joint and a small bag of marijuana weighing 0.86 grams.

Also arrested was Hanung Pekik Hermantoro, 25, a driver for The Green Room Villas where the Queensland painter was staying.
Prosecutor Deni Iswanto on Thursday finalised the charges against the men, pushing for Langan to face a maximum 12 years jail for drug possession.
'We have 20 days to hand this over to the court,' he said.

'At the moment, both are detained in the district prosecutor's cell and this afternoon, they will be taken to Kerobokan Prison.'
A family member refused to comment when called by Daily Mail Australia.

But seriously, what a fucked up world we live in.
And I am referring not just to Indonesia, but to all places that put people in jail for possession/use of drugs.

That sucks so much for him. It's why as a medical cannabis patient I have trouble convincing myself to even leave the state sometimes, it's just such a paradise in that regard.
 
seems like they want to make an example of western tourists who use drugs in their country in order to get the message across of how much they don't want tourists thinking its okay to use drugs in their country.

i don't think a local would be imprisoned for 12 years for a joint.

Toddlers can legally smoke cigs.

Its illegall for an adult to smoke a joint and people could spend 12 years in prison for doing so.

How does this make Indonesia apeare to the rest of the World.

Why the fuck do people even go to Indonesia? It's a backwards shithole that makes even some of it's neighboring countries look progressive by comparison. 12 years for smoking a joint and having abit of weed yet they let out a fucking radical Islamist who blew up abunch of western tourists after a few lousy years. That whole region is fucked but Indonesia is right up there with Malaysia in terms of being fucked.

The Aussie government should put a travel ban on visiting there in my opinion and also stop all trade with that shagging country. Id feel guilty even contributing to there economy. Perhaps the lack of western tourist money would modernize them abit

There too stupid and backwards to care how they appear to the rest of the world. I feel bad even having Canada stamped on my passport because Canada now looks like Reagan era US to the rest of the world and have enacted much of the same stupid drug policies. But Indonesia makes us look like Portugal by comparison.
 
The govts around the world are off their rocker.......they realized many years ago they could make billions from arresting & jailing people for drugs......its one of the biggest scams ever brought into our civilization.

They don't care if people do drugs, whether you overdose on heroin or come, or whatever.......the war on drugs is as laughable as seeing a woman with 3 tits.
 
There is a simple solution to the drug war nobody ever mentions. Outlaw the privatization & profiteering of prisons & jails worldwide. If the governments of the world had to pay for rather than make money from the imprisonment & jailing of criminals we would see a very quick about face in laws worldwide. Chiefly in the drug laws that feed the private prison beast.
 
Bali: Australian Nicholas Langan recommended for four years jail for sharing a marijuana joint

AN Australian who allegedly shared part of a marijuana joint during a Bali holiday is facing four years in an Indonesian jail.

And prosecutors in Denpasar District Court also recommended the same sentence of four years for the Indonesian driver who allegedly sourced the marijuana and shared it with Nicholas James Langan, of Townsvlle in Queensland.

The hefty sentence recommendation, under laws for drug users using drugs for themselves, surprised many observers.

The prosecutor’s sentence demand or recommendation is not binding on the Judges, who can hand down a sentence that is high or lower.

Langan has been in custody since his arrest on January 26, initially at the police jail cells and now at Bali’s Kerobokan prison.

The 25-year-old was on a surfing holiday in Bali when he was arrested and charged with possession of a partial joint of marijuana which he is accused of smoking with a driver from the hotel where he was staying.

He was initially charged with the most serious charge — drug possession, which carries a maximum 12-year sentence.

But that charge was not proved and instead prosecutors called for him to be found guilty of the secondary charge, for a drug user, under article 127 of the harsh anti-drugs laws.

Prosecutor Denny Iswanto submitted to the court that both Langan and the driver, Hanung Pekik Hermantoro, 25, had been proven guilty of violating article 127 of the narcotics laws.

“During the trial, we didn’t find any reason to forgive the defendant so the defendant must be responsible and declared guilty,” Mr Iswanto submitted.

He said the crime was contrary to the Government’s drug eradication programs.

Langan’s urine tests after the arrest were negative to narcotics, Mr Iswanto said but an examination conducted by the Bhayangkara police hospital declared both Langan and Hermantoro to be drug users, particularly marijuana.

So this guy did not smoke herb or use any other illegal drugs but now they are claiming he really did and going to put him in prison anyway? That's fucked up, and I'm not sure why anyone would want to go as a tourist to a country that has a corrupt court system like this, or drug laws like this?
 
Not sure, they say he was smoking a joint, but then the piss test was negative, maybe it wasnt weed after all.

Their drug laws suck, but so do many places. Just dont do drugs there. It's a pretty nice place really, tropical and huge, loads of places to explore, mountains, beaches, temples and heaps more. Just dont stay in Kuta.

Funny thing with their drug laws is that they had shrooms being sold legally in bars and clubs until 6 months or a year ago. I've had shrooms there a few times, bought in clubs and consumed infront of everyone, but that was like 15 and 20 years ago. I had awesome times there.
 
To think Indonesia was once a Dutch possession, complete with wholesale tobako and opium dens.

An Australian has been sent to jail for a year for sharing a marijuana joint on a Bali beach.
Nicholas Langan, of Townsville, was initially charged with drug possession, which carries a maximum 12 years' jail.
Prosecutors then asked the court to sentence the 25-year-old painter to a maximum four years for drug users.

The time Langan has spent in Kerobokan jail since his January 26 arrest will count towards his sentence.
During the trial, he gave a long apology for his actions, saying he had a history of marijuana addiction that he was trying to overcome.

Chief Judge Cening Budiana on Thursday acknowledged Langan had been 'polite and frank' with the court.
Also sentenced to one year in jail was Hanung Pekik Hermantoro, 25, a driver for The Green Room Villas, who shared the joint with Langan.
Police say they arrested the pair on a Canggu beach after midnight on January 27, after a tip-off from a security guard.

This is all a big money making machine for the Balinese, extortion is what it is..

I recommend reading the book "Hotel Kerobokan" prisoners there even have to buy their own cell.. Westerners are targeted by people like that security guard, because their families pay hundreds of thousands of dollars to bribe the court and pay for better living conditions, which going from the scentance is most likely the case here too. Innocent or not, it looks like a good sentance by their standards (and that they are just not ready to let go of their cash cow)

His family probably has paid a huge amount of money and going from the foto still does.. (he looks healthy, well clothed and clean) he might have relatively good conditions, they even have parties there, but at first you are confronted with what happens when you can't get money..

Prisoners without money experience hell on earth / are executed. This ultimately fuels this whole money machine that is Kerobokan jail...

The sick thing is...Inside this prison they have the best drugs for the best prices as inside they process most of the coca paste... They even had guided tours where tourists could go inside to party and use coke as long as they paid their way.. I know this sounds insane, but it's true...

Ok why not go to say Thailand instead of Indonesia? Sure they aren't exactly Liberal on drug policies either but usually as long as you don't fuck up to bad and if you have some cash to pay off the pigs your alright from what I've heard. Dunno why people go to Indonesia i mean fuck me id rather go to North Korea for a visit i think. Least ya won't be hung for smoking a joint.

Also if one was going to actually traffic drugs in these countries i dunno about anyone else but id much rather pack a gun and try and take out a few uniforms before i got taken out myself rather then spend the rest of my life in some godforsaken prison.
