Credit Card Fraud

While away at school, I got a credit card mailed HOME in which my mother used and created a blance of about 400 bucks which today the balance is 700 because of interest. Now, my mother is evil and will not pay, however the card is in my name, and its my credit being destroyed. What do I do?
 
well if you gave permission for your mom to use it your in trouble....if you didn't well...thats fraud

If you aren't, then you can certainly file an action in small claims court if you aren't able to work it out amicably with your mom.

You also might be able to convince the bank that your mother used your card and was not authorized to do so, it's a possibility they would not be able to collect the debt.

What city and state are you in?
 
no im not a minor, but the charges were made in November...I turned 18 in December... I'm in Columbia, MD... the only thing is it would be wrong to get my mother in trouble, however Im really concerned with my credit8(
 
just tell her that if she doesnt pay it back, you WILL file a fraud case.
no body wants a fraud case.
its your money.
think of it like she has stolen 700 dollars from you, which she has.
thats a lot of money.

dont take that shit.

if you are worried about your credit, get a loan and pay it off.
 
When a family member uses your credit card without premission it's fraud. I understand, it's a hard choice to make. But, look at it this way. If she did this to you once, there is a good chance she will try and attempt it again.

Even if it doesn't happen again, your credit right now is fucked. Takeing out a loan, to pay off the $700 isn't the answer. Your just opening another line of credit, not paying off any debt.

First, you must talk to her. If she isn't going to pay this back, or can't pay this back you must take action. Now, this could be fileing with the credit company, and possible legal action. This could be you asking another faimly member to help pay these bills, this could be you working a extra job for the next 4 months.

Bottem line is, don't let this debit add up and DO NOT open another line of credit to pay off this line of credit.

A personal loan will likely have far lower interest than a credit card. So if she cannot pay it off all at once, transferring the debt to a lower interest plan makes sense.

Partygirl, have you read the agreement that came with the card or have any information on the bank's policy in dealing with fraud?

Before you file suit or take out another loan to pay off the balance of the card that was fraudulently used, you should call the bank. My bankcard has a fraud protection policy that says I am responsible for only the first $50 if my card is fraudulently used.

If your bank has a similar provision, file a report for fraud as per its policy, and let the bank handle the rest.

You still have the option of small claims court. It is fairly easy to file a small claims action (I am not an attorney yet, but I have won a case in small claims court myself on a personal property matter. :))

This is off-topic, but have you considered family counseling to address the issues your mother and you seem to have? Just a thought. It's always better to resolve this sort of matter amicably without resorting to litigation, and you should definitely rule this out before you proceed with either taking out a loan or filing a small claims action. What does your mother have to say (if anything) in defense of her actions?
