A Brisbane jury has heard allegations a property developer was also a high-level drug trafficker who had threatened to bury two drug couriers under a building.

Property developer Morteza Kashani-Malaki, 45, from Highgate Hill on Brisbane's southside, has pleaded not guilty in the Supreme Court to drug trafficking and drug importation.

Prosecutor Glen Rice described Kashani-Malaki as being a high-level drug trafficker who brought and sold cocaine, heroin, ecstasy and methamphetamine.

Mr Rice said more than 200 telephone intercepts would be played during the trial, including discussions about the importation of cocaine from Lebanon involving two drug couriers.

He said in one conversation, Kashani-Malaki tells an associate he would put the two couriers under a building's foundations at St Lucia after they failed to make contact with him as arranged.

The trial is expected to last four weeks.

Mysteriously heavy suitcase leads to drug arrest
Amelia Bentley
June 17, 2009 - 1:01PM

A Canadian drug courier who smuggled more than $1.8 million worth of high-quality cocaine into Brisbane International Airport has been jailed for 10 years.

Candace Marie Brayton, 26, had 3.34kg of cocaine stashed under the lining of a suitcase when she flew into Brisbane on a Cathay Pacific flight from Vancouver in January last year.

Today in the Queensland Supreme Court in Brisbane, Brayton pleaded guilty to one charge of importing a commercial quantity of a border controlled substance.

Brayton, a former waitress, told Australian Federal Police after her arrest she had brought the modified suitcase containing the drugs to test Australia's airport security.

Commonwealth prosecutor Laura Manville said Brayton told police, "I guess the reasoning is to see how it goes through your security."

"She said, 'All I know is I need the money to get out of the situation I'm in at home.'"

The drugs were found when Australian Customs officers discovered that when the suitcase was emptied of its contents, it still weighed 13.9kg, Ms Manville said.

A swab test of the luggage returned a positive result for traces of cocaine and officers then found the suitcase had been modified to accommodate six rectangular packs of white powder inside heat-sealed clear plastic bags.

Ms Manville said the cocaine was between 72.9 per cent and 73.2 per cent purity and it was estimated the drugs had a street value of just over $1.8 million.

Defence barrister Julie Sharp said Brayton was addicted to cocaine at the time of the offence and had been enlisted by a Canadian woman who worked for a drug dealer to take the suitcase to Australia in return for payment.

She said Brayton was "a mere courier" who knew very little about the drug operation in which she was involved.

The court was told Brayton, being a foreign citizen, would find jail time harder than an Australian citizen, taking into account her family and friends were in Canada.

But Justice Glenn Martin said that was the risk Brayton took.

"That is a risk taken by any person who comes into this country knowing they are bringing a dangerous drug," he said.

He sentenced her to 10 years' jail with a non-parole period of six years.

He declared 17 months spent in jail awaiting sentence as time already served.

Man jailed for 13 years in multi-million dollar MDMA bust
Jun 17, 2009 5:15pm

A 56-year-old man was sentenced to 13 years in prison and declared a drug trafficker after he was nabbed in an MDMA bust in Waikiki in late 2007.

A 56-year-old man was sentenced to 13 years in prison and declared a drug trafficker after he was nabbed in a $6.5 million MDMA bust in Waikiki in late 2007.

Dusko Gligorovski was found guilty by a Perth District Court jury earlier this year on charges of conspiring to possess MDMA - a key ingredient of ecstasy - with intent to sell or supply and attempted possession of MDMA with intent to sell or supply.

Yesterday, Judge Kevin Sleight handed down a 13-year jail term after he told Gligorovski his conviction fell within the "worst category" of offences.

The court was told that in November 2007, a plumber was connecting deep sewerage at a house leased byGligorovski at Charthouse Road in Waikiki.

Whiledigging up the backyard to make a connection, the plumber came upon a 60-litreplastic drum buried in the ground.

Inside the drum were four large heat-sealed plasticbags. The police were notified and they visited the house.

The bags were tested and they were found to have contained 19.708 kilograms of MDMA or ecstasyin the form of a powder.

"The purity of the drug was 71 to 79 per cent," Judge Sleight remarked, adding he accepted the value of the drugs was "estimated to be somewhere between approximately $2.3 million and $6.5 million".

The court was told police removed the prohibited drugs and replaced them with another substance. They then re-buried the barrel and restored the ground to its previous appearance.

Surveillance cameras were established in the rear yard of the premises and also up the driveway.

Police then waited for Gligorovski and his 26-year-old son Igor - who was acquitted of the same charges during the trial - to come and collect the drugs.

"Although, initially there was some delay on your part, you and your son attended the property and the surveillance film shows you and he digging up the barrel containing the drugs and removing it from the premises," Judge Sleight said.

"Your son was acquitted of all the charges against him as it could not be established that he had any prior knowledge of the contents of the barrel."

The judge said the relationship between Gligorovski and his son "has deteriorated" and that Igor had not visited his father while he was in jail awaiting sentence.

The judge said there was no doubt Gligorovski had an intention to sell the drugs due to the "extraordinarily high" amount of MDMA.

"I am satisfied that your involvement in the conspiracy was very significant," Judge Sleight told Gligorovski.

"I am satisfied beyond reasonable doubt that the premises at Waikiki were rented by you at least at the time of the renewal of the lease with a view to obtaining an unoccupied premises for storing of the drugs."

The judge took into account in mitigation the man's age, his history of depression "and the fact that you have no relatives living in Western Australia except your son who appears to have disowned you".Â

He said a term of imprisonment was the only appropriate penalty in this case.

"The large quantity and the high purity of the drug found in your possession...suggested a high level of intended commercial dealing in a place in the hierarchy of drug trafficking very close to manufacture," Judge Sleight said.

"I conclude, given the extremely large quantity of the drug and the high level of purity of the drug and your direct involvement in the possession and storage of the drug that this matter comes within the worst category of offences."

Gligorovski will be eligible for parole in 11 years.

POLICE have alleged that a baby - who is still months away from having its first birthday - has been living in a house that was a cannabis nursery.

Officers who raided the house in Diamond Cres, Fairfield, in Sydney's south-west yesterday, found 100 cannabis plants growing in three rooms in a sophisticated hydroponic operation.

The plants have an estimated street value of about $200,000, they said.

A 41-year-old man arrested at the property was charged with multiple drug offences, including cultivating and supplying the illegal drug.

He is due to face Fairfield Local Court today.

"It will be alleged evidence was found indicating a seven-month-old baby had been living at the property,'' police said.

"The Department of Community Services was notified as a result.''

A 37-year-old woman arrested in the raid was questioned and released without charge pending further investigations.

Ecstasy arrest ‘a big win in the drugs war’

AN alleged drug dealer is in police custody following raids on three Lavington homes yesterday.

The woman, 32, was arrested after 150 ecstasy tablets and more than $3500 in cash were uncovered in the police operation.

Det Insp Brad Blanchard, of Albury police, said the arrest was a significant victory in the war against drugs in the city.

“We see it as having taken another supplier off the streets of Albury,” he said.

“It should be sending a clear message to those involved in the manufacture and supply of drugs that we are about, we’re active in that area and we’ll continue to be.”

Raids were conducted at homes in McDonald Road, Lavington, and Glenelg Drive and Gardinia Street in Springdale Heights.

More than 18 officers from Albury and Deniliquin police were involved, along with a sniffer dog from Sydney.

Glass bottles and an egg were thrown at media who had gathered in Glenelg Drive and Gardinia Street during the raids.

Residents also hurled abuse from adjoining homes, with one woman telling cameramen and journalists to leave the street alone.

Insp Blanchard said the raids formed part of an operation known as Strikeforce Judkin, which began with a tip-off from a member of the public about a month ago.

“From that information we’ve continued the investigation, identified those suppliers involved and made that arrest,” he said.

“We expect that further arrests will be made — it’s just a matter of time.”

Ecstasy seized in the raid is estimated to have a street value of $4000.

Insp Blanchard hoped the capture would deliver a considerable blow to the local drug market.

“We’ve run other operations in the past and we’ve seen significant results and reduction in the amounts of drugs that are around on the streets,” he said.

“We hope that this contributes to that as well.”

Insp Blanchard warned the police operation would be ongoing and that officers were taking a tough stand in relation to anyone caught with drugs.

“We won’t take a backward step when it comes to that sort of stuff,” he said.

“And if any members of the public have any information at all in relation to drugs, drug supply, drug manufacture, please contact us.”

The Springdale Heights woman was charged with the ongoing supply of prohibited drugs and will appear before Albury Local Court today.

Man charged over McDonald's ecsatasy deal

Friday, 19 June 2009 2:51 PM

A man has been charged over a $150,000 drug deal in a Sydney fast food restaurant.

Police say they observed a man passing a large brown paper bag to two other men at the Stanmore premises, in Sydney's inner-west, about 5pm (AEST) on Monday.

Officers stopped the three men and allegedly found 5,000 ecstasy tablets with an estimated street value of $150,000.

Detectives on Friday charged a 20-year-old man from Prestons in Sydney's southwest with supplying a large commercial amount of ecstasy.
He was refused bail to appear in Liverpool Local Court on Friday.

Yesterday a Sydney gunman, who held police at bay for eight hours in another McDonald’s restaurant on the NSW mid-north coast was refused bail in court.

49-year-old Dennis Borg is facing numerous firearms charges, after he stormed into the restaurant at a service centre near Port Macquarie, during yesterday's breakfast rush, firing his gun into the ceiling.

The case has been adjourned until August 8 - he'll remain behind bars until then.

Diners say he fired up to 12 shots, but no one was hurt.

“We heard a couple of shots – we were just pleased to get out of there,” a witness told Channel Ten last night.

Around 50 people were evacuated from three surrounding fast food outlets and a petrol station on the Oxley Highway.

Borg, who’s from suburban Doonside, surrendered to police at 4.20 in the afternoon.

McDonald's Australia spokeswoman Kristene Mullen said she had no idea what had sparked the stand-off, but praised staff for getting diners out of the restaurant safely.

"They are trained in a whole range of events so, obviously, when this happened they went into automatic pilot and it was handled very well," she said.

"Credit to them for getting everyone out safely."
