Gold Coast building investor Cele Markovski loses drugs appeal

October 09, 2009 12:50pm

A GOLD Coast building investor, described as a major player in Queensland's cocaine and ecstasy trade, failed in an appeal against his conviction and 15-year jail sentence today.

In the Supreme Court in Brisbane earlier this year, Cele Markovski, 52, was jailed for 15 years after being convicted on drug trafficking in cocaine and ecstasy during an eight-month period to March 2004.

Markovski was also found guilty of possessing nearly 500g of cocaine, which had been concealed inside a container falsely labelled as caustic soda and hidden below baby wipes.

It was discovered after he and his de facto wife were detained at a service station, at Currumbin, on the Gold Coast.

The court heard it was impossible to calculate if the value of his drug trade was "$10 million or $100 million" but the judge was satisfied Markovski was a person highly placed in a drug distribution network.

Police pieced together his drug trading through hundreds of telephone intercepts and also had to crack a code used by the gang.

Markovski, who was living in a new home on the Sovereign Islands at the time of the investigation, claimed to have legitimate building interests to justify his cash flow.

The jury heard tapes where Markovski referred to "splitting a block of land" worth $205,000 a few days before he was found with the half a kilogram of cocaine worth about $100,000.

Markovski appealed his conviction on five grounds and also his sentence as being manifestly excessive.

He claimed some telephone taped evidence was inadmissible and the judge had erred in some of his directions.

Markovski also argued the fact he had to serve 12 years of his 15 years sentence, as a serious violent offender, made it excessive.

He further argued that the judge had erred in finding he was talking about drugs when taped referring to a "block" in a telephone conversation.

Markovski produced evidence he was talking about a block of land.

However, in a unanimous judgment today, the Court of Appeal dismissed both appeals.

Drug dealer loses blame game

Tony Keim

October 13, 2009 01:54pm

A SCIENCE student has been jailed for 15 months for supplying ecstasy despite trying to claim the drug was planted as revenge by her partner's jilted ex-girlfriend.

Kristy Lee Huff, 31, this morning initially pleaded not guilty in the Brisbane Supreme Court to one count of supplying and possessing a commercial quantity of a dangerous drug between December 4 and 6, 2007.

It was expected Huff , a biomedical science, would defend herself on the grounds the drugs had been planted by the spurned lover of her partner - who was alleged to have made threats to exact revenge after breakdown of the relationship.

However, shortly after the jury was empanelled Huff changed her plea to one of guilty on both counts.

Prosecutor Jodi-Ann Thomas said police found 72 ecstasy tablets when they searched Huff's Wynnum home, on Brisbane's bayside, on December 6.

She said police also located Huff's mobile telephone which contained a copy of sent text message offering to sell the recipient of the SMS message a ``pool ball'' size quantity of drugs for the sum of $1100.

The court was told Huff initially told police she had no knowledge of the methamphetamine tablets - commonly referred to in drug circles as ecstasy - until they were found during the search.

Barrister Viktor Supranowicz, for Huff, said his client denied being a drug user and originally maintained the drugs were planted by another person, who then tipped off the police.

Justice John Byrne said no matter what Huff has originally claimed, it was now a case she only accepted and acknowledged her obvious guilt when it become quite clear her that the jury would convict her based on the strength of the Crown case.

Justice Byrne also rejected the assertion Huff was not a drug user, saying: ``I am satisfied you are a drug user.''

He sentenced Huff to 15-months jail, but ordered the term suspended after she has served three months in actual detention.

Jail for smuggling drugs in chocolates

October 14, 2009 - 11:29AM

AAP

An Austrian woman who smuggled the drug ice hidden in Toblerone and Ferrero Rocher chocolates into Melbourne has been jailed.

Nicole Demirkiran, 31, of Vienna, was found with a small plastic bag containing 0.2 grams of methamphetamine when her bag was searched by customs officers when she arrived at Melbourne Airport from Thailand on March 10.

Demirkiran was charged and released on bail.

But federal police later found more than a kilogram of ice hidden in Ferrero Rocher and Toblerone chocolates in her hotel room.

The County Court in Melbourne heard Demirkiran initially told police she was given the chocolates by an unknown person in Bangkok as a gift for her four-year-old child.

But she later admitted she received them from a large criminal network and believed they contained drugs.

Demirkiran pleaded guilty to importing a commercial quantity of methamphetamine.

Judge Barbara Cotterell accepted Demirkiran's remorse and that she had had a traumatic and deprived childhood that had affected her in adult life.

But she said a jail term was needed to deter potential drug smugglers.

"Without people like you who are willing to risk everything for very little, the drug trade would be severely limited," the judge said.

Demirkiran was jailed for five-and-a-half years with a minimum of three years.

The sentence takes into account the seven months she has already served in custody.
