Police prosecutor pleads for jail time but addict walks
Article from: The Courier-Mail
Sophie Elsworth
April 07, 2009 12:00am

A SELF-confessed chroming addict on 54 charges has walked free despite a police prosecutor saying "the community is not being served" if he was not jailed.

Dwane Daniel Morgan, 20, of Buderim on the Sunshine Coast, appeared in Maroochydore Magistrate's Court charged with stealing, trespassing, drug possession, breach of his bail conditions and obstructing police.

Police prosecutor Tony Hurley spent almost 30 minutes going through each of the charges, including many offences relating to a "crime spree" on April 16 last year, during which Morgan broke into six cars around the Coolum area.

Sen-Sgt Hurley told the court he believed the number of offences for one individual was almost the most he had ever seen in his long-running career.

"In almost all my years at the bar table this is almost a record (number of offences)," he said.

"His (the defendant's) situation is very sad but the community can not put up with this continuing. He is a person who must serve a period of imprisonment."

The offences spanned a 15-month period from January 2008 until March this year, which included Morgan stealing glue from a Woolworths supermarket and sniffing the substance inside the store before leaving.

He also stole numerous cans of paint from a Maroochydore business last year and was also found with blue paint smeared across his face and hands.

Defence lawyer Tim Hishon said his client had spent three months completing a drug rehabilitation course late last year and had employment opportunities.

He said his client was "not bad but he is sad" and he was "getting back on his feet."

Magistrate Bernadette Callaghan said Morgan's life was "pathetic" and "sad" but took into consideration his early plea of guilty.

"It's a very difficult sentence for me because of the large number of offences and clearly prison is something which has to be considered," she said.

"I would not be sending a 20-year-old to prison who is up on these offences."

While Ms Callaghan was reading out her sentence Sen-Sgt Hurley interrupted to dispute the sentencing, but she told him to "sit down and be quiet".

Morgan was convicted and ordered to serve 240 hours of community service, pay more

NEWS: 9.4.09 - Police infiltrate Sydney heroin ring

[EDIT: Threads merged. hoptis]

A MAN and three women are being questioned over a major commercial heroin ring operating from a suburban Sydney park, police say.

The 44-year-old man and the women, aged 34, 37 and 45, were taken into custody today after undercover police allegedly purchased heroin in the Croydon Park area.

Police also allegedly made controlled purchases of heroin from the drug ring on several occasions in February.

Simultaneous search warrants were executed at homes in Walsh Avenue, Croydon Park; Friend Avenue, Five Dock and Hercules Street at Dulwich Hill on Thursday.

Police and a drug detection dog also searched Whiddon Reserve at Croydon Park.

A haul of cash and a commercial supply of heroin was allegedly seized in the raids.

The four people arrested were taken to the Burwood Police Station where they are assisting detectives with their inquiries.

The head of the Drug Squad, Detective Superintendent Nick Bingham, praised Strike Force Lana officers for the success of the three month undercover operation.

"We allege we have dismantled a significant heroin distribution syndicate that we suspect has been using a suburban park as its base of operations,'' Supt Bingham said.

"Strike Force Lana moved in today and shut that operation down,'' he added.

"The team has worked hard, often in high-pressure situations, to put an end to the alleged heroin deals in that neighbourhood.''

Balgownie man found with ecstasy pills faces jail term

BY COURTNEY TRENWITH

16/04/2009 4:00:00 AM

A Balgownie man who bought more than 150 ecstasy tablets for friends attending a party is facing a jail term after pleading guilty in Wollongong Local Court yesterday to supplying drugs.

Timothy Frank Zerner, 23, never made it to the party last October. Instead he spent the night in a cell after police found scores of ecstasy tablets in his jeans pocket, car and bedroom.

Zerner came to the attention of police on October 11, when the party took place, when he was found inside a vehicle they believed contained a weapon used in a fight outside Collegians Club in Wollongong.

Police noticed Zerner was acting nervously and decided to search him, according to police facts tendered to the court.

They found four small, resealable plastic bags, each with 10 pink and brown tablets inside his jeans pockets and another 33 tablets inside the car.

Zerner immediately admitted to police that the tablets were ecstasy and that they were his, the police facts said.

Police also found two blue anabolic steroids, which Zerner told them he had bought from a male at a Wollongong gym. He said he had taken 100 steroids during the previous four weeks to "get bigger muscles".

Police also found an extendable baton, about 60cm long, hidden under a mat on the front passenger floor of the vehicle.

Zerner pleaded guilty to possessing a prohibited weapon, despite telling police he did not know the man who had passed the baton to him through the car window and said "take this" when he and a friend drove past the fight.

During a search of Zerner's house, police found a further 79 ecstasy tablets as well as purity-testing equipment.

Zerner told police he had bought the drugs the night before for $18 each and planned to sell them to friends attending his farewell party.

"I was having a farewell party and we were just going to have a big night," he said during a recorded interview. He admitted supplying friends on previous occasions to help support his own habit.

"I normally fork out and buy it for, like, the weekend for all the boys and all that and then they would give me the money for it," he said during the interview.

He denied making a profit.

"At the end of the day, no, I really don't because it goes back into what I (use)."

Zerner is scheduled to be sentenced in Wollongong District Court on May 15.

This was already posted in the bikie thread though deserves a repost here. 36 people arrested and while the online version doesn't mention quantities the report in the paper noted something like $250,000 worth of drugs + milions in cash and property seized. Of course the report had the usual hyperbole about the amphet trade in SEQ being completely smashed etc etc etc 8)

Drugs bust linked to four bikie gangs
April 22, 2009 04:07pm

QUEENSLAND and federal police today cracked a large methamphetamine trafficking network they allege has links to four outlaw motorcycle gangs.

Police executed search warrants on addresses in Toowoomba and on the Gold and Sunshine coasts in southeast Queensland.

Thirty-six people have been charged with 82 offences relating to the alleged possession of drugs, money, firearms and clandestine laboratory equipment.

It will be alleged the joint agency operation has dismantled a large methamphetamine trafficking network operating throughout southeast Queensland, police said.

North Coast Region Operations Co-ordinator, Acting Chief Superintendent Ben Hanbidge, said working with other agencies had proven very effective for Queensland police.

"Amphetamines are quite simply dangerous and potentially lethal drugs,'' he said.

"We are constantly working to prevent these and other illicit drugs from reaching the community and causing serious harm.''

Australian Federal Police Commander Brian McDonald said the operation was a significant achievement.

"This is an exceptional outcome for law enforcement as it continues to work together to dismantle drug syndicates and prevent drugs from reaching the streets of Australia,'' Commander McDonald said.

NEWS: 23.4.09 - Australian man could face 10 years in jail after Bali drug arrest

AN Australian man has been arrested in Bali on drugs charges.

The 33-year-old man was arrested outside a bar in Kuta in the early hours of Monday morning allegedly carrying about five grams of hashish, Bali police say.

Police say they intend to charge the man - who they have named only as JSM, believed to be his initials - with drug possession, which could see him jailed for up to 10 years.

"The intention of the suspect, JSM, was to have the hashish for his own use,'' Bali Police Drug Squad Colonel Kokot Indarto said.

"The defendant has not had the chance to use it.''

It's understood the man is West Australian, but has been living in Humpty Doo, in the Northern Territory. He flew into Bali from Darwin last week.

Police say the man was given the drugs by an Indonesian woman named Lili on Sunday.

"According to him, he's going to marry her,'' Colonel Indarto said.

Police found the drugs in the man's shorts pocket when they searched him outside Crusoes Bar, on one of Kuta's main tourist strips, at about 2am local time on Monday.

A spokeswoman for the Department of Foreign Affairs and Trade said the Consulate-General in Bali was providing assistance to the man.

"Consular staff in Canberra are providing assistance to the man's family,'' she said.

Police raid alleged bikie drug lab

Posted 5 hours 10 minutes ago
Updated 4 hours 45 minutes ago

Police have charged a 41-year-old man with manufacturing a commercial quantity of drugs, after a raid on an alleged clandestine drug factory at a property in Sydney's north-west.

Officers raided the Windsor Downs property this morning, after a covert police investigation that started last December.

Police say that specialist officers from the Drug Squad's Chemical Operations Team, Fire Brigades HAZMAT (hazardous materials) crews and forensic chemists also attended to secure potentially volatile chemicals.

Assistant Police Commissioner, Catherine Burn, says police found a sophisticated drug laboratory capable of producing a large commercial quantity of methylamphetamine.

She says a man was arrested at the scene, and later charged with drug manufacturing offences.

"We will be alleging that this man has links to outlaw motorcycle gangs, and we will further allege that this drug factory was capable of producing a commercial quantity of methylamphetamine, and this was going to be distributed on the streets by an outlaw motorcycle gang," she said.

She says the drug bust is part of a large investigation called Strike Force Kook.

"We've been doing this since December last year," she said.

"Earlier this month, on the 7th of April, we located another drug laboratory down in Bateman's Bay where we located several products capable of manufacturing the drug amphetamine and this is another link to that Strikeforce."

The man was refused bail yesterday and will appear in Penrith Local Court this morning.

NEWS: 27.4.09 - Major heroin ring smashed with arrests in Sydney and Melbourne

POLICE say they have smashed a drug trafficking syndicate and seized heroin worth $9 million destined for Melbourne's streets.

Officers in Sydney arrested a 59-year-old Footscray woman allegedly carrying 700 grams, or two blocks of high-grade heroin, as she got on a train bound for Melbourne on Saturday night.

The arrest led to a raid on a house in Burnside, in Melbourne's west, today where police arrested three family members accused of being ringleaders of the syndicate.

Investigators seized 5kg of heroin, with an alleged wholesale value of $2 million and street value of $9 million, 1.5kg of the illegal drug ice and cash, drug taskforce boss Inspector Doug Fryer told said.

Police allege the syndicate paid couriers to travel to South-East Asia and return with heroin concealed inside their bodies. Drugs were also brought to Melbourne from other Australian states, police said.

"They use a network of couriers recruited from various areas in Melbourne for a fee," Insp Fryer said.

"They (the drugs) are hidden by internal concealments. Having any illicit drug inside your body can result in death, so it's high risk.

"It's high risk for the couriers with death penalty provisions in other countries - even in Australia there's significant imprisonments handed out for just being a courier let alone the syndicate organisers."

Insp Fryer said police had been investigating the alleged syndicate for six months along with Customs, the Australian Crime Commission and Australian Federal Police.

Six men and women had already been arrested and charged with being couriers for the syndicate, bringing in heroin from Vietnam, he said.

As a result, prospective couriers were probably then reluctant to import heroin, but organisers continued running the syndicate anyway, concentrating on sourcing heroin within Australia, police said.

Two people were charged today including 52-year-old woman Thi Loan Tran, of Burnside, who was remanded at Sunshine Court for drug importation and trafficking offences.

A 27-year-old man was bailed on similar charges.

The raids had put a significant dent in Melbourne's heroin trade but a steady supply of the drug still existed in the city, Insp Fryer said.

"Five kilograms of pure heroin equates to about 20kg on the street ... that is hundreds of thousands of hits," he said.

NEWS: 29.4.09 - Police seize homes and property from drug syndicate

POLICE have seized millions of dollars worth of assets from an alleged drug ring, the second biggest haul in state history.

Several homes and commercial properties were seized by police as proceeds of crime.

A series of raids were conducted yesterday following an investigation which was launched in mid-2008.

Police executed 11 warrants on a number of properties in the Casey area, seizing around 1700 cannabis plants, a substantial quantity of money and other assets.

Eight people have been arrested and will appear at the Magistrates' Court later today charged with cultivate/traffick/possess commercial quantity of drugs, conspiracy to cultivate/traffick/possess large quantity of drugs, knowingly deal with proceeds of crime and theft.

The investigation commenced in the latter half of last year after police were able to identify a number of persons of interest.

Assistant Commissioner (Crime) Dannye Moloney said the intelligence-led, complex investigation showed that police were serious about stopping criminal activity in this state.

“We do not accept criminals coming to our state to engage in these activities and police will continue to target and prosecute them,” he said.

“These criminals are driven by greed, have no respect for other people or their property and the illicit drugs they bring into this state cause untold harm in our communities.

“Police have ... received substantial support and information from the community which is essential for us to be able to identify and break down these complex criminal operations.”

Jail for drug trafficker

HELEN KEMPTON

court-big.jpg

May 08, 2009 10:52am

A BURNIE woman who was found guilty of drug trafficking will spend 10 months in jail.
Justice Alan Blow said Loretta Ann Brooks, of Shorewell, had made over $120,000 through methamphetamine sales over three years.

A police search of Brooks' home uncovered 44 grams of speed in a backyard garden ornament.

"You said you had no knowledge of drugs and that your confessions to police were false,'' Justice Blow said as he sentenced Brooks to 18 months in jail, of which eight months was suspended.

"I am satisfied beyond reasonable doubt that you traficked in drugs.''

The court heard the 33-year-old had been charged for a multitude of more minor drug offences in the past and had received a one-month suspended sentence in 2006.

"There are some matters in your favour. You have admitted you are a drug user but you have cut back dramatically since you became pregnant with your daughter who is now four.

I accept you want to make a new life so I will suspend a large part of your sentence,'' Justice Blow said.

Brooks will have to attend treatment for her drug addiction on completion of her sentence.

Damn she is lucky she got such a short sentence, one of my mates got caught with 250 pills and 10g of ice and he got 2 and a half years in jail.

Of course he sold pills to under-covers twice so it may of been a different story and depending on how good his lawyer was as well would of made a big difference.

The ice wasn't even his though it was his girlfriends but she said he use to beat her, which he didn't, so she could try and get less time... She only ended up getting 18 months, but still this woman has been caught with 4 times that amount and she gets 10 months, that is unbelievable especially considering they knew how much money she made over the period of doing it, $120,000 isn't much though over three years, I don't know why you would even bother doing it if you were only making that much.

She would of been better off getting a full time job!
