Hi On-Lucid :)

Just wondering where you received the above info regarding the legalities of being in possession of a test kit in Queensland?

We live in QLD and have not heard anything of the sort...we know it's illegal to use the kit, but there is no issue with having just the kit on your person...we had a promotional eztest stall at advent*jah a couple of years ago, we were selling both bottles and single use kits with no problems... they sell test kits in various shops around brisbane...no problems...there is a site that you can purchase kits from within australia, people have had kits sent to them with no worries. The only issue would be that it's a corrosive material and needs to be handled accordingly. If laws have changed within the last month, we stand corrected. :)

In Queensland EZ-test kits are NOT legal. If you are caught or detected by customs you're deemed to be in possession of an illegal drug and will be prosucuted accordingly. Just thought Id tell you that as it could save some people unnessesary heartache.

just to clarify...

Using the kit for it's intended purpose, ie testing illegal drugs, is illegal due only to the nature of the substances you are testing. If you were testing your shoes this is not illegal. The act of using these kits is not illegal. It is the possesion of narcotics that is illegal.

Want an analogy? Guns are not illegal, although they are controlled. Murder, however, is illegal. Murder, in this case, is using guns for the purpose for which they were designed. You can own a gun,you just aren't allowed to use it for its intended purpose.

Just been on the phone to Qld Health. The guy I spoke with said he is not aware of any recent law changes in regards to possesion of kits.

As JB said, the kits are legal to buy and own but illegal to use on illicit drugs.
