This article doesn't specifically mention drugs, but I'm posting it because of its drug-related implications. Close if necessary.

Annapolis police raided the wrong apartment Wednesday night, using flash grenades and kicking a resident in the groin before they realized their mistake, police and the family said.

Police spokesman Hal Dalton said something must have gone amiss in the briefing beforehand. "We don't know how the mistake was made," Dalton said.

Silvia Bernal, 30, told The (Annapolis) Capital that about 15 officers burst through the front door of her apartment while she was cooking dinner about 8:20 p.m. She said the officers kicked her husband in the groin while she fled into a bedroom and barred the door with her body.

Then she said both of them were taken to the ground and handcuffed. The Capital said a police officer went outside and realized they had raided the wrong residence.

Dalton said they were supposed to have raided a different apartment and said the incident was regrettable.

Spa Cove apartment manager Latisha Marshall says there is a large dent in the front door. And she said there are two large black stains from the flash-bang grenades police deployed after entering the apartment.

When officers and the city's tactical squad went to the right unit, they said it was empty.

Can dude who got kicked file assault charges against the cop?
 
I'm sure there have been much more frivilous lawsuits...

I'm not sure if he could file criminal charges, but I don't see why he can't file a civil case...
 
As far as I know, the man who got kicked didn't do anything wrong, yet he was attacked by the cop in a rather sensitive area of his body. The only way I see that he wouldn't be able to file criminal charges is if the cop doesn't have to obey the law. Are cops above the law?
 
im gonna be fuckin pissed if someone doesnt file charges. And then ill be angry when they lose and nothing happens as usual.
 
If the dude does file charges I'm sure he can expect regular harassment and traffic stops, cop cars parked outside his unit all hours of the night.
The usual pig operating prochedure, his best bet is to file a civil case because he will win big, and then move out of the city or county.

In other news why is it so fucking hard to confirm a fucking address? Can't they do a little bit of recon and surveillance to make sure? For fucks sake how many times does this shit have to happen?

the swat team was all fucked on coke they got from the last bust and didn't care what door they busted down, they just needed some action.

They should have just pulled the ole Philly PD tactic and drop some fire bombs on the suspect's roof with a helicopter. ;)

They must have felt pretty stupid for making a mess, and still not getting the bust.

IMO the cop will and should settle out of court and give the man a reasonable amount for injury/pain. Its hard to determine that amount but figured in with the damage to the house and trauma of not knowing what the hell is going on ........ I wouldnt be surprised if the cops/sheriffs department ends up shelling out 10,000$ or more. I may be completely wrong though, because cops commit crimes daily and get put on paid leave so.... who knows? :shrugs:

Sue the cop? Bro sue the entire department and they'll settle out of court with their insurance company to avoid negative media and all that shit..... which kind of already happened.( Negative media that is) and $10,000 is very low, thats like wal-mart injury money. He's gonna need at least another zero at the end of that ten. His house got raided, and he got brutalized. He has the mental damage of having flash grenades thrown into his apartment, and his girlfriend too. On top of that he got kicked in the nuts. I'd do a lot of court time with them. To make sure it never happens again, to anyone else.

Yea but theres no children in this apartment to burn and traumatize. cant have police brutality without peaceful communes filled with children and animals to kill you know.
